Urgent -County Court SIP Parking Limited - Ticket Dispute

Hi all,

Fairly new to this forum but ive spent some time reading all of the pinned post’s and some other individuals cases.

I’m in a slight dilemma where I feel that I’ve been inappropriately charged for a fine.

To set the scene I was original served a PCN 30.09.2018 ‘please see attached photo’ this states that an incorrect ticket was displayed resulted in a fine being issued. There is photo evidence of two tickets displayed in my car covering for both the 29th & 30th September.

On the night of the 29th I returned back to my car to renew my ticket for the 30th the ticket machine I used previously was not working this resulted in myself and other motorist having to use an alternate machine elsewhere in the car park. I placed this purchased ticker in my car window and returned on my night out ‘please see attached photo’

I am at a cross-roads here when I tried to contest the parking ticket in 2018 It was brushed under the rug and I was given no explanation as to why the claim was rejected. On the advice of friends and family I chose to ignore further letters demanding payment as I was told they would disappear over time. This has not been the case as I have now been served with a County Court Business Center Claim. I don’t really want this affecting my credit rating in the long run but at the same time I would like to get this addressed in full.

 Personally I don’t feel I was in the wrong here as I’ve shown evidence of purchasing a ticket in full, I just think this is how these guys operate and will try to sting people out of money in the craftiest ways. I’d like to fight the claim but do not feel I have the evidence, time or standing to take on these behemoths who clearly do this for a living.

Do I agree will all of the claim and pay back in full or do I submit my N9 and ask for more time to provide a suitable defense into the courts.

i may also add im recovering from major heart surgery and im sort of along the lines of just paying the fine to not deal the induced stress on my heart.

Any advice would be welcome ?

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully, when life gets back to normal, it will become impossible for those scammers who are left to continue their vile trade, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    @Scapit -The tickets were both purchased from the same enclosed SIP car park, there was brick wall no more than 4 bricks high that divided the two parking areas each with there own ticket machine. On the 29th i was able to purchase ticket from the machine on my side of the wall. On the 2nd night this machine was broken so i purchased one from the other end of the car-pak.

    @Umkomaas - photo's were taken by myself on when i arrived back at the car park to leave

    @D_P_Dance - Unfortunately i dont have the luxury of time anymore with this being raised to the county court, i am also not a resident in Manchester though i am aware of similar activities happening in my area so i will address this to our local MP. Hopefully in the long run these types of people will have to find a new career.

    With a Claim Issue Date of 21st May, you have until Tuesday 9th June to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 

    To file an AoS, follow the guidance in a Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS, you have until 4pm on Tuesday 23rd June 2020 to file your Defence.
    That's nearly four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.

    Creating a Defence is also covered in the second post in the NEWBIES thread.

    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

     I’d like to fight the claim but do not feel I have the evidence, time or standing to take on these behemoths .
    We do and we will help you fight this claim.  Do not pay and do not admit any liability for any sum. 

    Follow what KeithP says and acknowledge the claim to be defended in full then go get the templaet defence from the NEWBIES thread.  It takes about 20 mins for people to add some facts in the red bits.  Easy, and you can do this.

    If this is the place, do a Google search for sip euro car parks browncross and choose IMAGES.

    Why didn't you park on street overnight, because the permit bays wouldn't be restricted?  Why use a private car park at all in any City (parts of London with red routes are the only exception I can think of - always park on street).

    The tickets look significantly different. Not sure what they are getting at unless they are issued by 2 seperate PPC's.

    @KeithP Hi Keith will sending an acknowledgement of service affect my ability to pay the fine in full if i choose ?  
    @Coupon-mad Thankyou for the advice i shall look at drafting a defense and get some sort of draft posted over the next couple of days.
    The SIP carpark in mention is located on 15 Tarrif Street Manchester, unfortunately i did not think to move the car, i also did not want to run the risk of leaving the car on a public street. In hindsight i would of avoided all this mess..
    @Scrapit @nosferatu1001 on review of the car park on google maps there two separate car parks on the same land one with SIP branding the second has no logo or affiliation. I was parked in the SIP parking bay for both days. On the second night all machines in the SIP area were not in working order forcing me to buy a ticket from the unbranded car parking area along with multiple other motorist. Unfortunately i was in a situation were i could not move my car, id accept the ticket in full had i gone out of my way to avoid purchasing any ticket. But the fact i spent £10 and tried to contact the company for a resolution on the night left me with not many options
