Euro car park, PCN, 14/08/18. Browncross Street car park, Salford, Manchester

Hi All.
The SIP and Euro carpark are both right next to each other. I bought a Sip ticket on my first day parking and parked in the euro car park side.
Was parked here for 5 days. Made this mistake on a Monday. Then bought 4 Euro car park tickets for 15,16,17,18 of August.
I have retained the ticket for all 5 days.
It's a confusing area to park. The SIP sign is giangantic.
The Euro car park is on the left of the big Sip car park. This is where I parked.
The sign is visible from the outside but when entered from the other side, can't be seen.
I appealed it through the online system but got it rejected.
I have uploaded all the signage photos under the imgur link.
It has captions which can help make more sense.

Car Park: Browncross Street - Manchester Breach of Terms and Conditions:
No valid pay and display/permit was purchased
Having carefully considered the evidence provided by you we have decided to reject your appeal for
the following reasons:
The car park is operated by Automatic Number Plate Recognition (ANPR).
Cameras capture an image of vehicles entering and leaving the car park and calculate their
length of stay on site.
When purchasing a pay and display ticket, you must enter the correct vehicle registration
number (VRM) and this information is directed to the camera system.
I can confirm that no pay and display ticket matching your VRM was purchased at the time of
the terms and conditions.
The signage is clear, a valid pay and display ticket must be purchased for the full duration of
your stay on the car park.
I can confirm the parking charge notice was issued correctly and remains payable.
The car park in question is on private land and upon entering such land vehicles are subject to the
terms and conditions of parking as shown on the signage. This signage quite clearly states that if your
vehicle is in breach of the terms and conditions of the car park then a Parking Charge Notice will be
issued.
On entry to private land it is the responsibility of the driver to check for signage and ensure that your
vehicle has been correctly parked. Any vehicles found not adhering to the signage will be issued with
a Parking Charge Notice.
Please be advised that there are a number of signs around the car park indicating the restrictions of
the site and it is the responsibility of the driver to read them when parking.
We note that in your letter you state that the parking charge notice (PCN) is not enforceable as you
have currently not entered into a ‘contract’ with Euro Car Parks. By parking in our ECP car park in
Browncross Street - Manchester you have entered into a contract with ECP and have consented to
comply with the terms and conditions set out on the signs in that car park which are clearly visible
wherever you park.

The car park contains signs within the car park setting out our terms and conditions. All drivers
therefore have the opportunity to review the terms and conditions prior to entering into the contract
with ECP by paying for a ticket.
The terms and conditions are clearly incorporated into the contract. If a driver elects not to review the
terms and conditions on the signage, this does not mean that the terms and conditions are not
incorporated. The parking charge notice (PCN) which has been issued is therefore lawfully binding
under the contract you have with ECP and we require payment within ten days.

There's a chance of winning if you use the templates in the 3rd post of the NEWBIES thread, and embed in the VERY LONG POPLA appeal (see examples all over the forum) your photos to prove how misleading the SIP sign is.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P.
for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently
