County Court Papers Receioved

I am a newbie on here and read the FAQ's and advice notes but could still do with some advice please.
I have received County Court Business Centre Forms and have the county court stamp so I presume they are original issued on 20/5/20 so I need to respond sharpish.
The papers are in relation to non payment of PCN issued September 2018. I had used their app to pay for parking but for some reason it paid for a different car park some miles away. I wrote to SIP to explain this and they did not reply but send further requests for payment. I next wrote to my MP who wrote to them asking them to stop pursuing me for this PCN and did not hear any more so presumed that was that until the court papers arrived.
I would like to challenge this as the amount for the car park should of been £2.50 for the day but due to an error in the app paid over £7, can you advise me of what steps to take please.

    do the AOS online asap , or this week sometime, to extend the time to perfect your defence

    email a SAR to the DPO at SIP to get all your data, attaching a copy of the claim form as proof of I D under GDPR

    START DRAFTING YOUR DEFENCE BASED UPON THE FEB 2020 EXAMPLE by coupon mad , altering just 2 or 3 paragraphs at most

    I have an additional piece of information to add. Above I said I had received no further communication from them but I have received Letter Before Claim which I thought was from another more recent PCN I did not reply to this letter.

    doesnt matter anymore. Youre past that point. 
    You MUST ack. the claim, using the precise instructions you find on the newbies thread, Tonight. NO prevaricating, do it and confirm you have done it.

    With a Claim Issue Date of 20th May, you have until Monday 8th June to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 

    To file an AoS, follow the guidance in a Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS, you have until 4pm on Monday 22nd June 2020 to file your Defence.
    That's nearly four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.

    Creating a Defence is also covered in the second post in the NEWBIES thread.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully, when life gets back to normal, it will become impossible for those scammers who are left to continue their vile trade, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    Okey doke - now please show us your planned facts (about the car park and app) that you want to put in as points #16 and #17 in the template defence.

    And make sure you change the statement of truth to the LONGER new one (gaaah, I am overdue an edit to the template defence...sorry).

    I have send my request for a SAR and the auto reply says they do not respond to emails for PCN's do I need to write a letter? This is the auto reply below.

    PLEASE NOTE: any email related to Parking Charge Notices (PCN's) will not be responded too.

    Any correspondence related to a PCN can be served via (removed link as I can not attatch) or by writing to SIP Parking Limited, PO BOX 5450, Manchester, M61 0JX.

    That just means the SAR email isn't to be used for PCN appeals.  The emailed SAR is OK, no need to post.
