Hi there, i note in the news that that the VW scandal case is progressing. Unfortunately I didn't sign up for the group claim, I knew nothing about it until after the deadline . Does anyone know of a way to lodge a claim now? Or should l just ask law firms directly?
Also if guilty does the court case pave the way for further claims against vw? Thank you for any views on this

There is no guilt or innocence in this scenario ... the claim is one of tort not criminality.
  • Contact the law firms, I'm sure they will be happy to add you to the list.

The loss, for those wondering, is loss of value, possible increased maintenance costs (extra urea used etc.) and increased health costs due to excessive dangerous emissions.

There was no Urea used in those diesel engines ... at least none that was user-serviceable. (I know, I had a 2012 Golf GT that was part of the "issue" batch. And no ... I didn't get any fix done - at least not to my knowledge - and I didn't jump on the claim bandwagon as I didn't lose anything).

And the engines were EU-compliant ... the "cheat" was only to allow passing of the extreme environmental requirements of parts of the USA (e.g. California). The "cheat" made no difference whatsoever in the EU so there were no "dangerous emissions" - at least none that were in excess of EU requirements.

There's only 1 legal company with an open group action claim running ... and they're not taking any further clients. (So that bandwagon has started rolling). Anyone else offering such claims aren't/won't be doing anything until/unless the group action is successful.

The only extant court case has long since closed to new claimants. Nobody knows whether they will win.

Other organisations may well be offering the opportunity to be part of other claim groups. Nobody knows whether they will get anywhere, even if the main claim wins.

None of Mojo's claimed losses are even remotely tangible, and they are certainly not legally enforceable in any normal circumstance. There is no evidence that VAG breached the rules on the applicable European tests. They were found to have breached the (very different, and far stricter) US tests, but they're not relevant to UK claims.

In that case anyone who has breathed the air in the country that a VAG vehicle has been driven can bring a claim?

Indeed!  If you're that adamant, hire your own solicitors.  It'll cost around £850 up front for an initial meeting and some legwork and then £150 an hour plus vat and disbursements.  Obviously when you win your claim, you can reclaim the costs.

Odd case, considering the plaintiff had no contract with VW as he bought the car used from an independent retailer and had not suffered any loss. Clearly civil case law is different in Germany to that of the UK as well as the courts so I'm not sure it's a fair comparison to make.
