Someone has fly tipped my waste, help!!!

  • @hazyjo of course I'll come and update. As I say, I don't mind paying the fine (will obviously I do kind, I don't want to lose out on up to £400 but it's better than a criminal record or prison sentence) because it was my stupid fault for not checking he was licensed, but to be honest it didn't even cross my mind! But I guess a fine will teach me for next time I want my waste disposing of!!

    Even here in NI where we still have strict lockdown rules. the tips and recycling centres have been opened to stop the fly tipping

    Op, a man with a van doesn't usually have a waste disposal licence and its always going to get fly tipped. Your local council will collect usually once a year FOC or for a set price ( ours is £10 ) if you cant take it to the tip yourself

    And whilst I have every sympathy for you, really I do, its always best to do the research before the event

    Hopefully the fact you have reported it will stop you getting fined
  • Hi everybody, not sure this is the right category but none matched. So I posted on a local group yesterday asking for a waste removal service. I hired a man with a van to dispose of some waste for me.  It's all been fly tipped by the man I hired, unfortunately. The post has now been taken down due to sensitive information.
    If you are worried about the £400 fine, why not go and collect your waste and dispose of it properly?

    Whether he trades as a sole trader or through a limited company is irrelevant. Did you check he possessed a valid upper-tier waste transfer licence?

    If not, then the onus IS on you.

    It's not legal just to pay somebody random to remove your rubbish. Showing your bank transfer merely shows you paid somebody some money for something (with no more paperwork than that), and doesn't make much difference.

    OP has acknowledged in the 1st post they didnt check their licence and that they know they are ultimately responsible.

    I expect they have messages to back up the bank transactions. But OP has also said they knows they are liable and will pay the fine if it comes.

    Should've = Should HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    This.  Have you taken steps to collect it?  That will likely (hopefully) mitigate further action from the council if they have to go collect your rubbish, also if it is like the rubbish dumped where I live it will spread out over the area.  Scribbling out your address isn't the answer, due diligence is (for next time).

    You need to either go and get that waste or pay someone with an actual waste carrier's licence to go and get it.  

    As it is, you are aware that your property has been fly tipped, and it still is.  I'm not sure what the position of the LA will be if it has gone, but if it is still there, they will be holding you responsible.   The actual tipper will be the bonus.
