And as the CJRS is a scheme specifically between employers and HMRC they are unlikely to be able to tell you what action they will take against the employer.

I think early days they won’t as unfortunately all helplines, live chat etc is for employer use.
When you read all the info on the HRMC sites re the scheme the onus was on the employers to keep their employees informed, transfer monies immediately etc etc to free up HRMC to help them keep their business.

I totally agree the initial contract is between the employer and HRMC but without an employees individual personal details the money could have not been claimed or authorised to the employer. It’s not like it was one lump sum to distribute to your workforce when and how you choose. No info, no payslips, Payments when they like, it’s all wrong.

I like to think at some point going forward companies who are blatantly helping themselves only will get what’s coming to them(in a legal way of course). I can’t fathom out any reason why payments are continuously updating on your tax account when you don’t have them especially when I can only compare to what I class as my decent employer and those payment amounts and dates match exactly.

The information on your Personal Tax Account is simply the Real Time Information reports an employer has filed with HMRC.

Obviously these should reflect the wages actually paid but that is not what some people are finding at the moment.

Presumably either wages will be forthcoming to match the Real Time details or the employer will have to file an amended report to reflect the correct details.
  • Well I've gone past the point of caring about not getting the money now. It is the way the process has been handled. I am not the type to just accept matters when I smell a rat. If the best that can happen is the sharks get investigated, that's fine by me. Also, I think it is very telling that they have entered those 4 payments, given that I've not done any work for them this new tax year. I want that cleared up and removed from my personal tax account.

That is unlikely to happen, the best you can hope for is that they file updated reports showing nil payments (assuming you never see the wages).

the other problem submitting RTI for payments that haven’t been received is that when the employee seeks alternative help such as Universal Credit then as far as the governments concerned they’ve received that income from their employee so any assistance is either greatly reduced or declined altogether.

I totally agree but apart from those Few with Let’s word it as less than favourable employers the details on there appear to match income.

Apart from now With this employer and furlough I have personally never had live information submitted that wasn’t correct.

Why even submit that information when you know you haven’t even paid the payments? Surely submitting and paying must go hand in hand within some reasonable and legal time limit at any time Nevermind furlough payments that have been entrusted to you by the government to transfer to your employee.
I obviously don’t know all the legalities as if I did I wouldn’t be asking for the valuable advice and support I have received on here. I’m just running my thoughts via my own what I at least think is common sense.

Could be for an entirely innocent reason - there are several. Such as thinking it would need to be declared on RTI before submitting a cjrs claim. Or forgetting to update a third party payroll.

I'm not saying they're not, just that we don't have enough information so it may be wise to keep an open mind
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride

I hope you get answers one way or another and soon. Yes could indeed have been a mistake but bottom line atm you were expecting it, it’s on your records(was on your records) and you don’t have it.. very strange indeed.
  • Hi Dotty. There's no innocence in this company. They have removed all trace of the contract I signed, changed my employed from date and replaced my furlough payslips with my payslips from last tax year. All the day after I informed the agency I was onto the outsourcing Co. Lie after lie, waiting on the phone 3 times for 20 mins last Fri only to be cut off. Telling you by text when moneys going into your acct then tell you that was sent in error. Utter BS. There are hundreds like us.
