Privately rented villa Corona cancellation

Ok tried the private renter. He says he is allowed to retain his expenses which is all that he was charging me ( legit. Its timeshare and he only charged management fee), so refund is nil. Tried COVERWISE again stating I have tried renter but still £800 out of pocket. They now say they don't cover for Covid 19, try my renter!
I paid my premium to them July 19 . . . Any more ideas please?

What does your insurance policy terms and condition say? Have you got these with you? Who is your insurer?0

You need to supply more details, when? where? was villa available? what method of payment did you use?familybevan said:Ok tried the private renter. Two issues, what you are entitled to get back and getting that money back.familybevan said:April 2020 in Tenerife. Resort closed 14 March 2020 still closed. Because it was private rental only payment option was bank transfer.
Tenerife was in lockdown in April so it couldn't be rented to you, so I believe you are due a refund under English law
Now the hard part, as you paid via back transfer, if you have two option, insurance or court action.
I would check your insurance policy to make sure you are't covered.

The issue here is I think more complex than where the contract was made: UK, Spain, or France? I doubt that the point of law varies much between the 3, as clearly the contract was frustrated by the lockdown and the OP could not access the villa. But, the reality is that, if the owner is based in France, then the OP would need to sue for the loss in France, as a claim in the UK would be impossible to serve.
On that basis, I agree with the above, and that the insurers are trying to evade liability, as in so many of these cases. So, commence a formal complaint, then use the FOS if that is rejected. No free lunch, and no free laptop

I contacted Coverwise and asked them to escalate this to a complaint. Also I received an email from them in April saying that all policies before a March date were covered for Covid 19. I reminded them of this too. Watch this space. Thanks again
