Freezer & Section 75

Hi,
I bought a freezer over Easter weekend using Barclaycard. The freezer was initially lost by the courier company then when it arrived 5 days late, it was damaged. There are various dents, the packaging was incomplete, it's scuffed, etc (you get the picture). After days and days of emailing and calling the store (with no response) as per their T&Cs, I completed a section 75 claim. Its been three weeks now and I've not heard anything. We've not been without a freezer for 5 weeks (other than the old broken one and the damaged new one) and we're having to edge around the damaged one everytime we use our kitchen.
My husband thinks we should plug in and use the new (damaged) one. I don't want to risk it if it will make a difference to the claim.
Can any one advise? I've repeatedly tried calling Barclaycard but have been on hold for over 3hrs before getting cut off.

It'll take weeks if not months to resolve the complaint, as Barclaycard will need to talk to the company and examine the case.
I wouldn't use the new freezer. Buy another in the meantime and get rid of the broken one. You don't need three freezers in the kitchen.1 -
Thanks, not the answer I wanted to hear but I suspected I would get. Our rubbish dump isnt open yet so it'll have to sit in the garden.0

In the meantime, the balance of the freezer is still on my card statement gathering interest. Is that right? I can't afford another freezer unless I know this is going to be refunded.

I feel you can use the damaged freezer (if you feel it's safe) while a refund is being sorted out, as it would be unfair to leave you without a freezer.
This way actually would save the credit card company some money, as you could rent a freezer and claim that money back as a consequential loss"
You have to keep the freezer as they might want it back (unlikely) as if the credit card company pays you, they will not want a damaged freezer.
So very possible that you will get to keep the freezer (if you want) or if you don't want the freezer charge the credit card company for removal.

I would agree with the above in that you should use the freezer until the shop collects it.
I suspect it will be some time until your S75 claim is paid but even when it is paid there was no point in unplugging the freezer and putting it in a corner I would continue using using it but keep telling the shop you want it collected1 -
You won't be looking at S75 to start with. As there are chargeback rights.

Trying to work out how a courier loses a freezer.
There are some dodgy courier drivers around I suppose0
