entry and exit pictures but car was moving

I got a PCN sometime ago from SmartParking claiming that I have parked at their place without paying for it. 
However, I was continuously driving and my car didn't stop. I wasn't familiar with the area and my car was brand new and big so maneuver to take a u-turn over there took me a lot of time. 
I have appealed but they rejected my appeal saying the entry and exit was 11minutes. 
Could anyone with some similar experience help me with this appeal? How would I write this appeal to get them cancel my PCN? It would be too time consuming to take to the court.

    I hope you did not reveal who was driving ?

    see the third post of the newbies faq sticky thread at the top of the forum , for examples and help on popla appeals (I assume you have a popla code ?)

    a popla appeal is based on

    NO LANDOWNER AUTHORITY
    POOR AND INADEQUATE SIGNAGE
    POFA 2012
    THE BPA CoP 2020

    see other appeals about grace periods and delays on sites like entering , reading signage and exit delays etc

    your best bet however, is a landowner cancellation, ASAP, if not before , quickstix , real quick , gettit ?

    Smart Parking will be suffering right now with COVID so they will reject.
    You will have your POPLA code and just one minute overtime is profiteering but that is how Smart work. The BPA who Smart belong to have already said the ANPR cameras are NOT 100% reliable.  So, as said above in your POPLA appeal

    they seem to be , they worked on way in and way out , thats 100% to me

    why tell the OP info thats of no relivence to situation , if they start adding that to appeal / court claim its just going to muddy waters with non relivent TO THE CASE IN HAND facts

    and its time you put the merlot down , smart are BPA not member of other micky mouse club

    so in the case of the OP , did the ANPR system work correctly or was there a fault with it ?

    Read what Pete Wishart MP said recently in the House of commons about Smart Parking.


    "I am sick and tired of receiving emails from people complaining about the behaviour of parking companies, telling me that they will never again visit Perth city centre because of the negative experience they had when they had the misfortune to end up in a car park operated by one of these companies. I have received more complaints about one car park in the city of Perth than about any other issue. That car park is operated by the lone ranger of the parking cowboys: the hated and appalling Smart Parking—I see that many other Members are unfortunate enough to have Smart Parking operating in their constituencies. It has reached the stage where one member of my staff now spends a good part of each day just helping my constituents and visitors to my constituency to navigate the appeals process.

    The BPA does not have the ability to regulate these companies and has shown no sign whatsoever that it is trying to get on top of some of the sharper practices. The BPA gives a veneer of legitimacy to some of the more outlandish rogue operators by including them in their membership, allowing them to continue to operate. The Bill will oblige operators such as Smart Parking to amend their practices.

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully, when life gets back to normal, it will become impossible for those scammers who are left to continue their vile trade, but until this is done you should still complain to your MP, citing the new legislation.
