Fraudulent Carers claim now being told owe £10,000

    Poppy has already answered with the right response, is that if they won't entertain me when I ring up carers allowance, as it is my dad's responsibility to inform them he is no longer caring for me, how can I be held responsible for paying them back, I know for a fact I did what I could to get the claim cancelled, and this is an example of them trying to force people onto universal credit such as this news article published today.

    It is not coincidence that a fraudulent claim happened, but this might force me onto universal credit to get my rent paid if the council find out that my severe disability premium has been stopped, how ever why have they removed my Severe Disability Premium after I've just got it reinstated when they will expect me to pay them back the SDP for 3 years, as I am still entitled to the SDP so there is no justification for removing it, I'm not trying to be rude to anyone I am just asking for advice.

    If your dad is still claiming carer's allowance then you won't be entitled to SDP.

    The carers allowance claim has already been stopped, and the SDP reinstated but then it was removed again, I did include this in my first post.

    It is possible for you to have got CA paid to your dad stopped if you said he wasn't caring for you for at least 35 hours a week. It does happen. However you need to provide a rough timeline when it was you phoned up and what benefit(s) you were on. By that I mean, as I posted, HB or ESA and HB as the SDP can be included / paid in both (though if both at the same time you would only have received the amount once, in ESA).

    I realise it's not easy to reconstruct three years of benefits claiming history in a single post (it's easier when speaking to someone face to face or on the phone as the correct questions can be asked at the right time plus it's not easy for everyone to type very quickly to provide full information while trying to concentrate on doing the typing!).

    That was why I asked whether the overpayment was for the ESA or the carers allowance, you cannot be held responsible for the carers allowance, it would be the person claiming it that pays it back.
    Unless the SDP has been overpaid because of the carers allowance, then you would be liable for the overpayment.
    You may need to report it as fraud and state that he hasn't been caring for you.

    You claim  to have ended it but it was still paid after that - hence the overpayment.
    Is it still being paid, as it has been pointed out you cannot stop the claim. It has to be the person claiming it.

    After ringing up carers allowance today, I was told that I should of not been made aware how long my dad was claiming carers allowance for so the agent at ESA slipped up, but it seems they are aware of it all being fraud, and a nice agent at ESA is looking into it all today and will call me back sometime today.
    It seems a difficult one as it's relating to a family member.

    Also this has made my doctor speed up my autisum diagnosis as my dad will try to take advantage of me again in the future and I won't be letting that happen.
