Euro Car Parks- POPLA appeal, please help!

    Yes , pay any Court judgment within the timescale set by the judge , usually within 30 days , the matter is over and done with , the CCJ the judge issued is expunged , so no issues on the credit file , nothing to do with parking , it is the way it is

    It is ignoring the judgment issued by the judge , including the 30 days to pay in full , that the CCJ is placed on file

    It is easy to tell a story without using the words my , me , myself and I , please edit your posts above , what happened on the day happened to the driver , anything since happened to the keeper
  • I wouldn't bother with POPLA unless the PCN arrived after day 14 and you can show it was a non POFA one.  That sign is OK.    POPLA are not going to say that was unclear and the car park is quite small by the looks of it.

    Did you not think to pay more and keep both tickets, and/or cover your rear numberplate as you left past the 'out' camera so no PCN could be generated anyway?  Protect your data, you do NOT have to show your numberplate.

    Luckily this is only ECP who never sue for individual single PCNs and if they try, there is no risk and that's the ultimate 'appeal' stage.  Keep all letters.  Please no flapping when the laughable debt demands arrive, promise us you CAN ignore those and no showing them to us...please...they are so tedious!

    It is a fairly small car park, yes. In my naivety, I had no idea there were cameras and just saw it as there’s no fine placed on the windscreen and therefore the overstay had gone unnoticed. The NTK shocked me in all honesty, I was not familiar with this technique!! 
    it’s easy to say ‘no flapping’, but honestly I’m the worlds biggest flapper!! If I am not mistaken, there have been cases of ECP taking single PCN’s to court and winning?
    i’m aware I don’t have a compelling excuse so I’m trying to weigh up the negative effects on my mental health of receiving these horrible letters vs having to pay £100 whilst on a mere statutory maternity pay!!

    I meant you talking about other court cases mentioning Ecp , because there aren't any by Ecp , but there are by NCP , read the section quoted by coupon mad , it's your words

    I think not. I've been here 12 years or so.

    This will only affect your mental health if you let it (I am not being blase when I say that I promise, it's about being informed, it gives you mental strength).  You need to read threads and look at some pictures to expect what the daft debt collector letters actually look like.  If you know what to expect it is actually funny when they tick that box and the daft letter arrives!  The letters are laughable and we show you some examples in the 4th post of the NEWBIES thread. 

    Look at the photo by a poster who showed their impressive collection re 10 PCNs or so, they had about 60 DRP letters in their photo! You will get a letter every 3 months and then it will stop, and if not, big deal really, you get more letters.  
     
    Thank you- that is a little bit reassuring at least. The Beavis case- is it possible that mine could go that way?
    Do you recommend not bothering with POPLA? 
    I’ve looked through the newbie threads and I’m honestly shocked that these debt recovery companies are allowed to send such harassing letters! 

    One more question (sorry!)- if it did go to court, I honestly would not be able to attend and represent myself due to anxiety. Would that be marked negatively against me on my credit file? If a judge asked me to pay, obviously I would pay immediately. I just really do not want ANY negative trace on my credit records, that’s my main concern.

    so ECP have never taken anyone to court!? (On a single PCN, that is)

    You can have the case heard on papers , no need to attend , we do not recommend it but if needs must , then it's your case

    Court attendance is not mandatory and has no impact on your credit file

    Yes if ECP try a small claim but I'm saying it's highly unlikely for a single PCN and I've ignored them myself  and collected the debt letters.  I am also a Mum and had young kids and I used to keep a few of the 'alarming but laughable' demand letters my handbag to show colleagues at the school I worked at, if they started fretting about fake PCNs.  Threw them away after 6 years had passed.  The letters stopped after maybe a year.

    In your case, unless the PCN arrived too late (after day 14?) I can't see the point of POPLA for you, and I get the impression when you lose at POPLA you'd be intimidated and pay.  We don't want you to do that, nor be intimidated.

    No, because if you lost you'd just pay about £175 and no CCJ.

    If a judge asked me to pay, obviously I would pay immediately.
    Quite right - you will NOT get a CCJ then!

    As long as you don't move house and not tell ECP (silly move some people do, then get a secret CCJ at the old address they find out about too late).  Don't do that and you will have no CCJ at all.

    You are safe.  If you get a court claim, you do know you can just make and offer and pay at any point before the hearing anyway?  This is nothing to worry about and almost certainly won't happen but can be paid off, if you really worried at the time and wanted to make it go away then.  But STILL no CCJ!
