Bestway hot tub warranty

Hi, I am looking for some advice on a warranty. We purchased a Bestway Lay-z-spa from B&M on the 15th July 2019. It worked perfectly for the rest of the summer and was then stored correctly. We put the tub back up at the start of April and it is showing an error on the pump. We contacted Bestway support who have asked for proof of purchase. We are unable to find our receipt and as we paid cash B&M are unable to help and we can’t use a bank statement. The product however has a manufacturing date stamp which proves it is within 1 year old. 

Bestway are saying that they are unable to carry out a warranty repair as we do not have a receipt even although we have proof it’s within 1 year old and therefore must be under warranty. 

Is there anything we can do, it’s an expensive item to have for a few months then bin, esp when still under warranty. 

Thanks in advance for any advice you can give.

    I'm afraid not.  Not under warranty, anyway.  Warranties are offered at manufacturers' discretion so they can set the terms.  The date stamp doesn't help because it doesn't prove that you bought it.  Warranties are often non-transferable. 

    You might consider exercising consumer rights instead, but that will be difficult without proof of purchase.

    Unfortunately as above, you're a bit stuffed - they need proof you purchased it, and that it wasn't 'off the back of a lorry', stolen, 2nd hand etc (as your rights only apply to the initial purchaser). 

    You're a bit out of luck on this, I'm afraid.

    That's not quite right - the legislation doesn't dictate any particular form of evidence (such as a till receipt) being required by the purchaser to prove who/when/where the purchase was made, at the end of the day it would be up to a court to decide on the balance of probabilities whether you can prove your case.

    At the very least, there's certainly no harm in the first place in approaching the retailer on the (truthful!) basis that you're the customer and the item isn't of satisfactory quality.

    You need to contact B&M, as that's who your contract is with.

    Yes contact B&M there’s a possibility that if you give them the date and approx time off day you bought it, they could trace the sale and issue a duplicate receipt

    But be aware that such a task will be very low priority for them at the moment.

    Thanks folks. Looks like I will be out of luck. I contacted B&M before all the lockdown madness but as I paid cash they cannot trace the transaction to me. Thanks for all the advice. I’ll put this one down to experience and keep receipts in future. Lisa

    Have a look on Google or YouTube & see if you can sort out the problem yourself ??
    Might be something fairly easy to repair.
