    Nothing else from Virgin or Expedia. Latest (today) from the credit card, is them asking if the return flight is cancelled.  I sent them a copy of the email from Expedia who stated that my flight is cancelled, so now back in the court of the credit card company.

    They should have asked you to confirm to are not taking it,   as it doesn't matter if it's cancelled or not,  once the outbound is cancelled then that's the breach of contract.

    Yes, when I replied I included that Virgin had breached their contract.   They (credit card) should, I understand, also return any money that leaves a balance in my favour to me for free.  The flights are over £1,000 and I have a £250 balance on the card to pay off, although I have now set the direct debit to the minimum while the chargeback claim is in progress.

    I have read enough Ombudsman's rulings that show that some CCC just don't understand how a S75 works.

    4/6 - still nothing from Expedia/Virgin and waiting on the CCC having sent them info they asked for.
    But, thought this would interest those who have Virgin bookings, posted on the Virgin FB page today:

    If anyone is doing a chargeback via Capital One, it's like pulling teeth!  They've asked for the same information three times now, I'm wondering if they don't get their act together do I complain to the Financial O, or go at them with a S75!!!

    The trouble you will have with a S75 is you have used Expedia to book Virgin flights
    The court has ruled that third parties are allowed,  but the Ombudsman rules that this in "unfair" so say they are not allowed.
    So if you file a S75 you have a better chance of a court ruling going in your favour than the Ombudsman.

    I was surprised to find out the Ombudsman doesn't follow case law in regards to S75, as 3rd 4th & even 5th parties  have been ruled allowed.

    24/5 - good news from my credit card - stage 1 of my chargeback request.  
    "...have been claimed from the Merchant. Also, any interest or fees charged in relation to the transaction will be refunded".

    Now just to wait for stage 2 - funds in the account.
    And the 45 day wait.
