Help with fence and neighbour...

My left wall runs along two neighbours back wall. Second house in the photo is complaining as I have put a 6 foot fence up on the top level (it is 3 levels) this comes down in height by each level. She is threatening to sue me for all sorts of reasons over this fence, am I right to have the fence 6 foot off the top level even though hers is lower down? All other neighbours are fine with it and I have bent over backwards to keep her happy even cutting a tree down she has been complaining about to other owners for years. The level was raised by previous owners.

General rule of thumb - Garden fences (and hedges) should be a maximum of 2m from the ground level. If your garden is three foot higher than hers, as long as your fence is a max of 2m on your side, no problem.

The maximum height without planning permission is 2m, but I don’t know know how that’s measured when there’s a step down. If you have cut off all the light into her garden that’s going to be a major problem for her, and I don’t know what you gain from it?The planning portal says “not exceed two metres in height (from ground level)”. As your garden was built up previously, the height may we’ll be measured from your neighbour's garden, in which case you would be in breach of planning laws.No reliance should be placed on the above! How much higher is that section of garden compared to the lowest section? A bit late now, but if you have had problems with her in the past it might have been better to use the lowest point as the datum.

Page 9.Height and ground level 2.10 As defined in article 1(3) of the Town and Country Planning (General Permitted Development) Order 1995, height is measured from ground level - “Ground level means the level of the surface of the ground immediately adjacent to the building in question, or where the ground is not uniform, the level of the highest part of the surface of the ground adjacent to it”.

If you reduce the height of your fence to 2m off the ground in her garden, anyone in your garden will tower over the fence and she won't have any privacy.If you want to reassure yourself that your fence is okay, you could ask the council to come and check it - but that probably won't happen until lock-down is over.In the meantime, I'd ignore her complaints.2

Thank you everyone for the response. The garden is a lot lower on my side, there wouldn't even be no point in putting a fence up if I went from the lowest it wouldn't cover the wall. I need the fence higher as its not safe and my children could topple over no problem which is an issue when it is so high. It doesn't cut off light in her garden. I had a large tree there in the corner which she caused issues with previous owners as she didn't like when leaves she'd etc. I cut it down to keep her happy as she kept putting her head over my wall and harrasing me about it, now she is harrasing us about the fence. So she gains a lot of light from tree being cut down anyways.1

here is tree befor. It got a lot bigger than this this was from two owners ago. So she does gain light. The fence really isn't that much higher on her side maybe 1 ft?
