Tough Mudder Refund Rights

It seems that they are now a different company ... https://www.companyrescue.co.uk/guides-knowledge/news/administration-for-tough-mudder-4439/0

If it's the case that the company you contracted with went into administration (have you checked?) then you only have a claim as a creditor in the administration (by contacting the administrators), which is likely to mean you get nothing (or almost nothing). Though if you paid by credit card you may be entitled to make a s.75 claim from the card company. You have no rights against somebody new who is using the same trading name.0

I'm having the same issue refund agreed with TM on the 26th march and a cancellation invoice sent to me on that date, after I advised them I could not attend either of the two future London dates. Then a month later and email going back on the refund, stating that I had bought my ticket in 2019 (which they were fully aware of when they agreed with the refund.)Cu3tard said:Have been advised today by Tough Mudder that they will not issue refunds for tickets bought in 2019 for any 2020 events which are prosponed, even though they confirmed in writing on 06/04/2020 that they would, as apparently the original company went into administration and was bought over (totally unaware of that until this all happened). Can anyone advise what my rights are on this?
Ive raised it with my credit card provider so we live in hope.0 -
if you paid by credit card I’d ask them to raise a section 75 claim.
if you didn’t, whilst it isn’t ideal, if you really can’t make the future dates you could ask the new company if they will accept ticket transfers. There are lots of running groups on social media so you could sell your ticket to someone else- provided the new company are ok with transferring details.

Unless the amount paid was more than £100 (per ticket) then S75 won't apply.1

Or you could just ask your debit/credit card provider to do a chargeback..sarahking87 said:if you paid by credit card I’d ask them to raise a section 75 claim.

I seriously doubt that Tough Mudder charge over £100 for a ticket

Chargeback against whom? The company that was paid and no longer exists?

Tickets purchased prior to January 29th 2020
Your original ticket was purchased from a company called Tough Mudder Ltd, which entered Administration in January 2020. OCR UK Holdings Ltd, a subsidiary of Spartan Race Inc, acquired some of the assets of that company out of Administration along with the license to operate Tough Mudder branded events in the UK.
We areed to honour your ticket at the event you’d originally registered for or at another Tough Mudder or Spartan event. If the event you are registered for is cancelled or postponed we remain committed to providing your Tough Mudder experience at one of our future events and will be in touch with you regarding options.

Refunds are available for tickets bought from the new company but not for those bought from the old company.
I suspect that those advising about the refunds were not made aware of this.
By concession they offer to transfer your ticket to a future even but you are not entitled to a refund from them.
That claim is against the administrators of the original company and you would join the list of creditors.

a standard TM ticket is about £85 (coming from the hobby widow of an obsessed husband) , but if you add a t shirt, or a parking space, or any of the other extortionate extras they offer it can easily be more than £100. Depends what the OP has signed up to!DoaM said:Chargeback against whom? The company that was paid and no longer exists?
