Entitlement for a refund of my puppy that passed away after 10 months.

Hi, 
In August 2019 me and my partner purchased a KC registered puppy. Unfortunately in March she passed away, the vets have said it was due to underlying health issues and the breeding of the dog was that bad the breeders should not be able to breed. She cost £2,300 and we have further since paid around £1500 in vet bills. I just need some advice as to whether it would be worth taking to a small claims court or not? Regards.

    I'm afraid I can't offer any advice but didn't want to 'read and run' without saying that I am so sorry you lost your pup in this way, it must have been very upsetting :(

    I am sorry too to hear the news. Not good for you or a puppy........ really sad infact.
    Unfortunately KC registration means pretty much- zero zilch nada but perhaps you could contact KC first of all- they might have some helpful advice. 

    In the intervening period did you have any contact with the so-called breeders?

    I'm thinking that a dog is very probably considered a saleable item/a good/chattel.
    There's a lot of info on this website about making a claim. Iassume your vet would be willing to provide statement / paperwork .
    It might be worth contacting your local council trading standards dept to ask for their help
    Being polite and pleasant doesn't cost anything!

    One question, did you ever have your dog checked out by your vet when you bought it or any time before March?

    We have been in contact with the breeders and their response was awful hence why we wanted to take it further. The vets have said they are willing to provide us with all of the information needed as they are the ones that said the breeding of Bonnie was awful. I've reported them to the council and to the website they advertise off as i think they may be over breeding but i haven't had a response. She was checked and taken for her second lot of injections when we had her. She passed away from Chronic Pneumonia but the breeding issues were her bones in her back legs also, she would've came to us with pneumonia but as she had it for such a long time it developed. When she had pneumonia we had to have xrays on her lungs as well as her back legs as all of a sudden she struggled to walk. The vets said they've never seen a puppy (its usually old Alsatians, she was a british bulldog)  with such bad bone structure and they resembled it to a fracture or injury but she had never sustained one.

    Unfortunately after sucha period of time the onus is on you to prove the 'item' was faulty. (dogs are considered property / goods)

    If the breeder is as bad as you say what chance of any redress do you have?

  • My question isn't what redress i have it is whether i have a case with a small claims court. 
    Also, you could say that about many breeds of dogs. Not every Bulldog is born genetically wrong and they're one of the most loving dogs you could own. Yes they come with problems, but your negative input after such a loss is not warranted.

    If it not about redress then  what do you expect to achieve by going to the small claims court, other than monetary recompense?
