[new driver] questions about not at fault claim_Auxilis & third party payment

MovingForwards said:Admiral are your insurance company as you were covered by them at the time, their obligations do not end because your policy was cancelled.
Did you pay your insurance premium yearly or monthly? Did you get any refund?
Auxillis are an accident management company, who have put you in a credit hire car and trying to get their money back for that as their priority, with your losses off the back of that.
If they cancelled your policy how long was left on the policy and any refunds etc?
If you had claimed on your own policy Admiral should have allowed you to cover the replacement car on the policy so if Admiral's business agreement with Auxillis has ended up costing you money due to the delays then an Official Complaint may be in order

If there are problems with the claim (The third party may be trying to say you drove into the back of them) you may have a case against Admiral for pushing you to Auxillis. You can still claim against your Admiral policy

Do you mean I should claim on my own insurance company (Admiral) for pre-accident value and car hire cost first, and if Admiral pay the me claim later 49 weeks from the date of the car hire Agreement , I can make an official complain?
The following are the Terms and Condition,4. Unless paid at the time, or before, hire commenced You shall pay all Charges except Deferred Charges as soon as the hire period ends.5. As on the basis of what You have said We reasonably believe You had a motor accident for which someone else ("Third Party") was to blame You are required to pay the DeferredCharges to Us in full in a single payment on the sooner of;a) 49 weeks from the date of this Agreement; orb) immediately after the Deferred Charges have been paid by a Third Party; orc) immediately after breaching any of Your obligations under either clause 8(i) or clause 8(ii) below and We have notified You that We require payment; ord) upon Your death, bankruptcy or inability to give instructions about Your Claim for any other reason.
Thank you so much for the help!!0 -
You claim from admiral for the pre accident value less salvage and excess, you can't claim for the credit hire that's claimed from the third party / her insurance.
You will have the remaining policy money deducted from it, but that should go towards your new premium for your car, provided it's within a certain time frame. Car insurance is an annual policy and the whole premium is due when the policy is started, monthly tends to be a finance agreement and that's why it costs more overall.
No need to cancel the credit hire vehicle at the moment, you need to use that to get to find another car.
You will have a claim on your insurance, need to disclose it (as you do anyway as you've had an accident).Mortgage started 2020, aiming to clear 31/12/2029.1 -
It should take Admiral around a week to cancel your policy and the around a week to refund the money to you. Have you received the money back yet?1

Someone advised me to call the third-party and ask them directly whether they accept the fault but not to discuss the liability. It is because Auxilis has no interest in talking with the third-party and just in case I said something to prejudice my case.0 -
There is nothing stopping you calling and asking them to confirm whether or not they are accepting liability.
I suspect he will have told them you drove into the back of him

I called Auxilis again and recorded the conversation yesterday. As their assistants said so many times that I was not at fault and I didnt need to pay for the car hire costs in the past phone calls, that's why I thought the third party had already accepted the fault and I didn't need to pay for car hire in any cases and signed the agreement. This time, I asked the assistant whether I need to pay in any cases again she said no. And then I asked what if the third party didnt agree on the payment/ the fault, she told me that they would bring the case to the court LOL...0 -
But what about the value of your vehicle?
Auxillis, and other credit hire companies, default response is they will commence court proceedings. That doesn't always happen if liability isn't going to settle at a minimum of 50/50.
