MBNA PPI - Pls can anybody help.

    Thanks yes I understand that. I haven’t actually been able to get to the part of reason for rejection as they were writing to me at my old address ( so had sent letter asking for Korea information there) and therefore decided I hadn’t been Mis sold on limited information .
    They adv reason I hadn’t been Mis sold being I would have been over 18, working etc so could have claimed. 
    They haven’t replied to my request to look at it on the basis of my medical condition. ( I have updated address and been to a bank to provide proof it’s me and now received the Sar) .I have sent a letter to chase and email and had no response so only have a week now to submit to Fos. Thanks for all your advice and responses everybody.

    Hi, Thanks form all your help and responses so far I appreciate it.
    i think I am now going to have to submit to the FOS.
    i received my original letter from MBNA on 4th Nov ( Written 1Nov). In this letter they state they have made decision not to uphold.
    * Credit card opened 24/6/98- you purchased PPi on the same date by way of postal application. ( The Sar says this is not available)

    * non advised sale 

    * the conditions required you were over 18 under 65 and a UK resident in permanent employment. I am satisfied you met this criteria.

    * The cost of the policy was 69p per £100 of the statements balance. Ignore you made a successful claim the policy could cover at least 3% of the balance in a statement period. This could have been paid for up to 12 months unemployment claim. In the event of accident  or sickness the policy Could have paid out until you returned to work or the claim was paid in full.

    I have considered the info and believe you you would have recieved benefit from the policy in the event of accident, sickness unemployment ot hospitalisation.

    Mbna have made this decision on the back of my electronic submission submission on their website. They according to the Sar sent a questionnaire to my old address.
    i have since sent the questionnaire back asking them to re assess due to my medical condition. 
    I have recieved no response to this, an email chasing this and sent a final letter last week asking them again as the FOS date was nearing.

    i am unsure whether the postal application had the box pre ticked as they don’t have it on file. 

    I am also unsure whether the wording they hve used above means I could have been covered for my medical condition ? 

    And does that 3% mean they would only have paid 3% of my balance if I was not working ?

    am I right in thinking I will have to submit to FOS by 1 Nov ?

    Only online applications ever had PPI as the pre-selected option. A postal application would not ever have had this.
     It's not a valid complaint that they no longer have a copy of the original forms.
    The wording of the letter indicates that your condition was covered to the extent that it would  pay out as long as any illness or unemployment was not as a direct result of your epilepsy. Such an exception is allowed and is not a valid complaint. 

    On what basis then (other than you want money) are you intending on referring this to the Ombudsman? 

    You don't seem to be able to counter any of the  reasons the bank gave for rejection. 

    Finally, you have only six months to make a FOS referral.  So as  you received your rejection letter in November, you now have just a few days left before it's too late.

    Thankyou for your reply. I have sent a letter back to MbNa to ask whether my pre existing condition would have meant that I would not have been covered by the PPI for instance relating to this ( and per other posters comments). 
    That is what I have asked I don’t really want to have you submit to FOs but can get no reply from MBNA on this.

    There’s is also a note in the sar log that I have cancelled PPC in 2006 in a phonecall. I do not believe this to be true and have statements (  not available in the Sar but that I have kept) showing PPI still being charged in 2008 etc. 
    Map the documentation is confusing.

    Your complaint has already been rejected. Since you've left it almost six months since that time, you need to make a hasty referral to the Ombudsman rather than wait for any more clarification from the Bank. 

    From what you say, though, it sounds like the most you will receive is the Plevin refund already offered.

    It really doesn't matter when the PPI ended. If the complaint had been upheld you would have received a full refund of all PPI paid in any case. 
    You appear to be grasping at straws here...

    Thankyou. I will submit to FOS today. I was only questioning as their original decision was based on no information from me. They wrote to say they would re look at it with my questionnaire or further information. I have sent this but heard nothing despite chasing 2/3 times. I didn’t think it was unreasonable to write back with in the information they requested to see if that made any difference to my case that was all. Thanks for commenting and your help.

    That's all well and good, but if six months have almost elapsed you have no choice than to go now to the Ombudsman or you'll lose that as a future option.  Rather than simply refer the complaint, you should explain to FOS that you've sent additional information and you are awaiting a response from the Bank. 

    Realise also that the reason the Bank have been tardy in responding to your second submission will be down to the huge backlog of complaints they still have due to the avalanche they received prior to the deadline last year. In addition, the Covid19 pandemic will have delayed things even more. 

    The FOS is similarly impacted so don't expect a resolution to this anytime soon...

    Yes i I’ll do that. I understand their backlog and the circumstances I wasn’t just trying to chase them to see if I could resolve with them first.
