They have just refused the offers I have sent as they are very firm on their valuation of how much I owe.
Unfortunately the insurance company won't want to talk to you now, they will want you to speak with their solicitors. I suggest you offer to pay the whole amount and negotiate a monthly payment that you can afford. There really is no other option.

Also OP that is not a defence, but rather admission of liability. As above re payment, because you owe money whether you like it or not.
There's another thread on here where the OP didn't check their policy was live and had an accident, who is at fault you think?"It is prudent when shopping for something important, not to limit yourself to Pound land/Estate Agents"

5 years later here we are, i was reading through this thread and thought i might aswel post the outcome.
So the case was concluded at a hearing over a phonecall as it happend during covid. the judge ordered for judgement against us both (me and my father) as I failed to file a legitimate defence, and so solicitors applied for bankruptcy cases aginst us both. i knew from here on it was only going to get worse, so i requested a settlement figure, the amount was in the region of £15k. payment plan wasnt an option as this would likely affect our credit at the time, So out of desperation i managed to get a loan and pay it all off at once, without getting a ccj as i cleared the amount within 30 days of the judgement being entered against us. not the outcome we wanted ofcourse but i would like to highlight the importance of ensuring you have a legal team who deals with this, because MAN! it was stressful at times handling the paperwork and responses to court orders on my own without any legal experience. but oh well, definitely a lesson learned.
I d like to thank you all for taking the time to respond to the thread at that time!6 -

I would suggest the highlight is to check you are insured before driving.1 -

The one thing many dont realise, personal injury compensation debt does not get eliminated by bankruptcy in England & Wales. Them attempting it to liquidate assets etc makes sense but were it you trying to avoid the debt it wouldn't have worked.
Agree with the above... if you are the driver, make sure you are insured, if you are the vehicle owner, make sure the driver is insured. Have dealt with 6 figure uninsured cases in the past - much harder to get a loan to get out of those holes.0
