OK I am seeing if anyone is available to assist with a skelly.

    Meanwhile, more urgently:

Please now make a real difference - A TASK FOR SEPTEMBER.

The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    https://standardsdevelopment.bsigroup.com/projects/2020-00193#/section

You do not need to register to comment on the enforcement framework which can be found here. It has a link on page 5 to make comments.

    https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/913272/Code_Enforcement_Framework_consultation.pdf

At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.

And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

Please be heard.  You can bet the hundreds of PPCs will be commenting.

No apologies for repeating this vital 'call for action' to consumers, on every thread this month!

    Hi All
Just an update on this - I had my hearing this afternoon and the judge was impressed with the paperwork submitted by me thus far (so thank you all for your help and advice), however they have ordered for the case to be reinstated due to the lack of evidence held by the judge that struck this case out originally.
I have a hearing set in February for a separate case (mentioned in my other thread), albeit identical to this one. Am i able to request that the two cases are combined so that I only have the one hearing?

Yes and you could have asked today.  Why not follow up with an email to the Judge to ask that this is included in his Order.

As said, roll 2 into 1
Let the judge dismiss both at the same time.
No doubt the earlier judge struck out the case for abuse of process (fakery)
Nothing changes about the fakery and again, no doubt DCBL will try to rely on the BWLegal appeal in Salisbury.   You must understand that appeal and how meaningless it is so you have the answers. The appeal has done BWLegal no favours and it will be the same for DCBL.

Infact, the BWLegal appeal has helped Judges to use their own autonomy to dismiss cases for other reasons, knowing the fakery practice is still abuse of process ... but, they won't actually say that.   We are seeing that now

DCBL will have to wait until february 2021 and the PPC will be screaming out for money. But, the PPC must understand that once fakery is involved, they will not get a penny

In my opinion, before PPC's instruct these legals, they should take independent professional legal advice about fakery
