DCBL appeal against order for case to be struck out
Comments
-
Hi all
Just another update in the DCBL saga - I've received Court forms today stating that DCBL have submitted an application for the order to be set aside pursuant to CPR 3.3(5)(a) and for the claim to be reinstated. I have a hearing in November for this (telephone), so going by the guidance assuming i have to submit a witness statement and exhibits? Any additional guidance would be greatly appreciated. I am considering finding a solicitor to act on my behalf.
They have stated in their WS that "it is noted the defendant's defence is a template commonly found on internet forums aimed at 'getting away' with parking charges, which is evident from the fact the Defendant was able to obtain copies of the documents annexed"1 -
I doubt you will find a solicitor who knows more about unregulated parking scammers than the regulars on this forum. You don't need one. If you do find one willing to take your case it will cost considerably more if you lose than without them. This forum has a most excellent win rate as long as posters follow the advice given here.jav12 said:Hi all

Please do not take this as advice. It is my opinion. Other opinions are available.
As for the comment about an internet template defence, most judges who have seen this have said, "so what."
Did you complain to the ICO about the lack of response to your SAR? If so, what did they say?I married my cousin. I had to...I don't have a sister.

OK I've seen it and your emails and will look to see if someone in my group can assist.
Do you have till late October (not less than 14 days before the hearing) or do you have a set deadline for the WS and evidence and skeleton argument?

Just seen this .....
DCBL have just copied this from BWLegal just as they copied the fake add-on
FOR A JUDGE ... if a judge asks you although most judges will find this a feeble attempt by DCBL
Due to the added UNKNOWN SUM, which was not shown on the signage as such, I conducted an Internet search for such information. My statement is relevant to the case in hand
It's another reminder to the judge about the fake add-on
What would be good is to see DCBL come out with something on their own initiative as apposed to copying a failing legal

The letter states that "whoever is responsible for emailing documents to the court must do this at least three days before the hearing to the court's email".Coupon-mad said:OK I've seen it and your emails and will look to see if someone in my group can assist.
