But technically she has a job, just no start date. With that in mind, can she still claim this new style JSA?

Yes because at the moment she's not working.

Ok thanks. I will pass it on to her.

Another way to think of it is that anybody who starts a new job is pretty insecure and can be sacked at the drop of a hat. Any scheme of this nature will have winners and losers, anything requiring a cutoff always has somebody who falls on the "wrong" side of the line. It is impossible to cover every eventuality and prevent abuse at the same time. If there are no childcare opportunities, there are other opportunities that the unique COVID situation has created.0

The scheme needn't have winners and losers if the government hadn't left it to previous employers to decide whether or not to rehire and furlough ex employees. How stupid. Why they haven't based it on the previous years earnings, like they are doing with the self employed is beyond me.

No, they can’t do this, they need to use the money to survive until they can work again.geoff258 said:My neighbour is one of the poor sods who have fallen through the cracks in the Governments Furlough/Job retention scheme. She left her children’s nursery job on the 27th March and had a new job due to start on the 6th April. Of course the new employer now can't give her a start date, and the previous employer is refusing to rehire and furlough her. Until such time as something is done to fix this glaring flaw in the scheme (Martin and co. please help!) her only possible option of any income is Universal Credit. Unfortunately, because her dad gave her some money intended for a deposit on a flat purchase, she has over £16000 in the bank.
Until this unfair furlough system is fixed or she can start her new job, can she return this money to her dad so her savings are below £16k and then claim UC so she at least has some small income?
Thanks in advance for any help.

Unfortunately, they can't please everyone. She has the savings, that's a lot more that some people have.

You're missing the point; they could please everyone if it was thought through better.

It doesn't matter how many times the rules are changed, there will always be people that fall through the cracks. She left he previous employer after lockdown was put into place....

She left her previous employment with a new job ready to go to, and now has no income and can't be furloughed, she is at no fault. What is the matter with you?
