Hi everyone 
My title deeds read "Together with a right of road for the Purchaser to and from the
premises hereby conveyed from and to......... Road aforesaid through
the gateway and over the yard of the adjoining property numbered aforesaid for the purpose of conveying ashes refuse coal
and garden manure as heretofore used and enjoyed."
I would like to ask what this exactly means,my neighbour currently parks cars on this pathway and expects me to ring and ask everytime I wish to throw away grass etc
Also if I am getting work done at back of house can this path be used to bring in material,builders to come in and out 
I would rather do this with mutual understanding but unfortunately he is a very awkward guy!!!
If he continues to leave his cars and is adamant what can be done 
If I take a legal route can I reclaim costs?

    it means what it says, you have a right to use that access route/path for the purposes stated.
    it does not include using it for building materials 
    it does not say must be kept free of obstructions 

    sounds like you are hell bent on expensive confrontation
    he may be "awkward", but it takes two to tango

    I have tried to work on this mutually many times over but I don't like somebody making me feel they are doing me a FAVOUR everytime they move the obstructions when it seems to be my legal right
    surely if I have a right they wouldn't be allowed to obstruct it as that would defeat the purpose of having the right?

    To be honest I hardly need to use it but I am fed up of my neighbour laying down rules and times for when I cam access

    So they remove the obstruction when asked and allow you to use the access?
    You could go to court and request an injunction prohibiting them from ever blocking the access, but a) this may fail once the judge hears that access is being granted on request and b) the cost, time and stress woul make it only worthwhile for the satisfaction you might feel from winning.......
    Perhaps asking for access on a more frequent basis might achieve the same result - the neighbour might get fed up having to move his car, and start parking elsewhere.
    Is there in fact an obvious alternative place for him to leave his car?

    They do but sometimes can be awkward 
    For e.g if I am doing gardening and want throw grass,soil etc then they would limit it to a certain time and try to make things difficult 
    I need to get my garden done so I contacted the guy who could have easily said its difficult atm but went on a rant about why I buy this property blah blah blah 
    And how he opened on so and so day and so and so day
    I actually asked him to park his car slight away form my entrance so I cam squeeze out but he refused to do so and wants me to phone him and ASK...

    When I initially moved he had put a door behind my door to stop me even going onto pathway and denied that I had a right but eventually gave in without admitting that I did have a right

    It is a yard behind my house in which he keeps his cars,he obviously has more than he has space for hence parks them in the pathway and also sometimes on the road
    I don't really want to give anyone hassle,but feel forced to

    well your options are
    * full scale legal action - uncertain, costly, stressfull etc
    * a solicitor's letter - which might have the desired effect or might be ignored, but will cost you £100 or so
    * a war of attrition - annoying him consistantly with acess requests in hope he eventually stops blocking
    * accept the status quo and live with it
    * make friends. Tea and cake - though the cake may need to be really extra special by the sound of it!

    I've sent a solicitor letter before but he wanted a PROPER letter,dunno what that is 😂😂😂
    If I'm in the right can I not reclaim the legal fees that had to paid due to someone else's awkwardness
