BW Legal threatening County Court for unpaid parking fine

I received a parking fine from Britannia Parking when I pulled in to a pub car park and stopped for 16 minutes to check a warning light on my VW campervan. I unsuccessfully appealed through Britannia and POPLA and now BW Legal have upped the fine to £160 and have given me until 29th April before commencing County Court proceedings. Is there any way out of this other than paying the exorbitant  fine (the ticket was apparently £1.50)?  I’m a teacher so can’t be going to court to fight this kind of thing. I’ve heard a company called ‘parking fines.org’ can get the fine overturned if you pay them £18 - does anyone know if this works and if they’re reputable?  I’d be really grateful for any help/advice. Thankyou very much.

    Firstly, you do not have a fine, just simple invoice
    BWLegal are scamming you with a fake £60 to which the courts keep spanking them for Abuse of Process.
    But they just carry on scamming because they think you are a mug?
    The letter is a chase up letter if they want you to pay by the 29th.   Before any action can be taken, they must send you a "letter before claim" giving you 30 days to respond and including proof of their claim... assume you do not have that ?

    You will see many court spankings for BWLegal adding on their fake £60

    There is a letter you can send a letter either now, or wait until you get a "letter before claim"

    The point of the letter is to show BWLegal that you are not a mug and you know about their scam
    This letter can be shown to the court, if it gets that far.  Their reply if any can also be shown in court because BWLegal have no LEGAL AUTHORITY  and they can only reply with a lie.

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.


    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully, when life gets back to normal, it will become impossible for those scammers who are left to continue their vile trade, but until this is done you should still complain to your MP, citing the new legislation.

The latest letter from BW Legal is headed ‘Letter of Claim’ and states that they’ve been instructed by Britannia Parking to commence legal action in the form of issuing a claim against me in the County Court. If payment isn’t received by 29/4/20 they will issue claim in County Court. Given my profession (teacher) I can’t let this get to court but equally don’t want to give companies like this my money - particularly as I only stopped in the pub car park for 16 minutes and didn’t get out of the campervan.  Thanks very much for any help/advice.

    Why not?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Why not?  This is a civil matter, a dispute over a debt.  If a plumber mucks up your central heating would you not sue him?.  I suggest you visit the internet and read all about contract law.  Please tell us that you have read the newbies .

    A letter of claim is different to a LETTER BEFORE CLAIM.   When was the letter dated and did it include forms to complete (which of course you don't) 
    PLEASE DO NOT CONSIDER PAYMENT as these are scammers and every penny spent with them goes toward the next scam, maybe nurses and care workers

    The Letter of Claim was dated 25/3/20 and yes, included a reply form relating to paying the debt (all or part of it) and how I’ll pay...

    Ok, so you must reply ....... and that letter is your reply adding you deny any debt

    Do not get confused in their name, BWLegal are only glorified debt collectors, REAL solicitors would never scam you.  It is the scam they gets them spanked in court.

    Because BWLegal cannot prove they have Legal authority to add fake amounts like the £60, they will try to fob you off with nonsensical rubbish like these ....

    * contractual charge
    * admin costs
    * debt collector costs
    * legal fees
    * The CoP of each ATA says they can do it.
    ALL OF WHICH IS RUBBISH

    SEND THAT LETTER

     A red light on a dashboard could signal an imminent catastrophic   engine failure, (piston throgh the bonnet, windscreen covered in oil, seized braks, no brakes at all)..  If you had continued to  to drive an accident could ensue.   I am  sure that no judge in the land  would agree that in such circumstances, you breached a contract to park.  
    You never know how far you can go until you go too far.
