Argos refusing to refund

Your Consumer Rights are with Argos, the warranty with Dualit. As you purchased the item less than 6 months ago, consumer rights legislation assume the item was inherently faulty at time of purchase unless proven otherwise. You are entitled to a remedy with Argos.

Take it to Argos and they send it to the manufacturer for a report .Or you contact the manufacturer and see what they say .Does not cause a problem with customer rights but is usually quicker .0

If you push them hard enough they’ll take it, but all they’ll do is send it off to Dualit for you (adding to the repair time).
After 3 months they’ll likely repair and not replace.0 -
Argos will have a contract with Dualiti to handle all warranty after 30 days,id guess they will replace it for you.

Thanks to those who have provided input. I contacted Dualit Customer Services who sent me an email and advised me to present it to the Argos branch demanding a replacement. We'll see how it goes. FYI the email is pasted below:
Further to our telephone conversation this is to advise that the above Lite Toaster is not a toaster that we are able to repair due to the nature of its construction.We are very sorry that you are experiencing a problem with your Dualit product. If an appliance fails to operate properly, while in use under normal household conditions and within the warranty period, normal procedure would be to return the appliance to the store or retailer where purchased.Under UK law, the Contract of Sale is between yourself and the retailer and it is principally the retailer’s legal responsibility to assist in resolving any issue with the product within the full warranty period (and not just in the first 30 days). Failure of the retailer to do so is in breach of your statutory rightsI understand that it was purchased in November from Argos and therefore it would need to be returned to them under the warranty.0 -

Go in with politeness and just say you followed their advice to contact dualit who have referred you back to them and show the email, you'll be more likely to get a timely solution this way.0
