solicitors refusing to provide statuatory declaration

Hi, i have one final outstanding enquiry on a property puchase, and it is regarding the unadopted land over the rear access of the house. Basically there is an access pathway for homeowners crossing the back of the row of terraces.
My vendors solicitors have drawn up a draft indemnity regards this, however they are refusing to say that they require to provide a statuatory declaration (so my solicitors can present to my lender, along with the indemnity).
What is a statuatory declaration for in this instance? Why would they be refusing to submit it? Is it costly?
This is the last hurdle before completion, and quite frankly it's doing my nut in.
Any advice? I keep pestering solicitors every day but they don't seem to be moving this case!

So what's the indemnity policy and/or statutory declaration about? You haven't told us anything that's actually a problem.
