    It may be a similar scenario (regarding the spaces) to a current poster who was at court this week (no details of outcome as yet).

    There are developments of flats and houses with parking spaces and the parking spaces that belong to the forum member's property (house) appear from the plan to be freehold spaces.

    It's been a dreadful hassle for the forum member as it has impacted on their relationship with their employer as there was a company car involved.

    It will be interesting to see what the outcome of this case is however given the issues I would not be surprised if it is still ongoing. 

    The reason that the OP may have been excluded from the vote could be because they own the spaces.

      The managing agent did not write to me and most likely to most flat owners though they did write to me when there are repairs . So we were excluded deliberately and this is another legal issue that can be raised after my court case against the parking company. Out of 150 residents only 10 voted. Is the appointment legal? 
    Unfortunately with our block of flat there is a steering group rather than a proper resident group and only 3 flat owners were selected by Berkeley Homes apparently (funny enough two of them own the penthouses) and decisions being made I must say are terrible as I am now told that service charges of last year had rocketed by £2k.

    It does not seem as if you are having a very good deal from the managing agent. They are usually appointed by the landowner, the party to whom the ground rent is paid.  Have you taken the matter up with the landowner ?

    I rent out a flat and the service charge is £75.81 per month and it has not changed since I bought the flat three years ago. The managing company get any work done when necessary and buildings insurance is included as is window cleaning, cleaning of the communal area's and gardening.  As yet there is no PPC managing the car park and the only issues seem to be is that some residents use the visitor spaces as their second allocated space.

    All the leasehold owners must be allowed to vote.  Tenants don't have that right but can rely on whatever rights their landlord has.

    I issued a legal claim for damages against Parking Control Management (UK) Ltd and once the court case is on I will put updates here. I had sent them email of intended legal claim and waited 14 days as I told them that there was no contract with them for parking enforcement for my own allocated parking space when I first saw the parking notices but three weeks later they trespass on it and put the PCN on my car. 
    We are a family with young children and were given a parking charge notice for my car that was parked in my own allocated parking space. I had phoned them when I first saw the parking signs and told them that I had never appointed their company to enforce parking in my own allocated parking space and was told I was automatically opted out as I own the parking space. Three weeks later the company put a PCN ticket on my car and when I phoned them and told them I never appointed them they pressured me to send land registry details that contain my personal info so that they will stop the enforcement. Now during the COVID-19 lock-down they sent me a debt collection letter and the debt collection company kept phoning me and note that I am working as I am on the front-line. Even their website mentioned they are closed and the government guidelines said that they should not pursue PCN collection during this period, they are doing so and foremost affecting front-line workers. Parking Control Management (UK) Ltd was given an ASBO by Windsor and Maidenhead Councils and was the first company to be given an ASBO.
    I have also set up a petition to make this harassment criminal in this period (once petition is live I put links) after my claim for damages had been filed.

    On May 24 2021 I won judgement for tress-pass and loss of income  against Parking Control Management (UK) Ltd for issuing a PCN on my car on my residential parking space.
    Their argument was I did not own the car parking space and they had an agreement with the management company in their defence. 
    It was clear that they were not properly appointed by the management company and now all residents in my development can consider a claim against them if they issued a PCN on their car

    Had PCM taken advice from a real legal they would have saved a lot of money ?

    The message to PCM is to seek professional legal advice first before claiming anything. ... otherwise it will cost you a lot of money

    We will see just how intelligent PCM are in future ?
