They wont. You'll have to pay it all then get it back from the other person

It's a joint and several liability bill, there is no share that's just an agreement between you two.

Both are responsible for the full amount.

Is your housemate entitled to benefits / council tax reduction as it would be worth them looking into it.
Mortgage started 2020, aiming to clear 31/12/2029.

    Answer is as above.
What other bills/rent do you share and are these also a problem?

Creditors don't care who they get the ££££ from: With a joint & several debt (tenancies, Council tax, mortgages..) each joint punter is responsible for ALL the debt.

    AFAIK always been like that.

They will take all of you to court if you don't pay.

There is no apportionment of the council tax charge. Where you have a joint council tax liability then all parties remain equally responsible for the full payment.
The council will almost certainly obtain a liability order against all parties however they may then only, at any one time, take enforcement action against one individual (they can halt action and change the party they pursue at at any time). If you can show to them that you have paid towards the debt they may or may not choose to pursue the other parties first - the decision is entirely that of the council.

I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

  • It’s a joint tenancy. I can prove I have paid my share via bank statements.

As others have said that doesn't help you.  You can be pursued for the full Council tax for the property.  You can also be pursued for the full rent.

Your house mate needs to get sorted out with the relevant Government support scheme or benefits etc.

As far as your council tax liability goes there's no such thing as "your" share.  Each of you has joint and several liability for paying the full amount.

If you can't afford to pay the full amount on your own then speak to the council and see if you and the other joint tenant can get some breathing space and/or agree to come up with some payment plan.

The other joint tenant needs to find out if (s)he is eligible for any financial help during the lockdown.
