Restaurant refund for cancelled reservation

I paid a deposit for a booking at a restaurant to celebrate a birthday. Now that we cannot go due to the current restrictions the restaurant are refusing to return our deposit and saying that we can rebook once they reopen. This is not acceptable to us since the birthday will be long gone by then. Does anyone know if the Consumer Rights act can be used in this situation?

Suggest to them that you will accept a credit voucher for 10% more than you paid???

If every customer insists on a refund they’ll go bust and you’ll get nothing.I would take their offer and have a celebration when lock down is over!4

I have a sneaky suspicion that the birthday should come around again in, what, about a year?8

Go when they open and celebrate the birthday then, gives you something to look fwd to and will help the economy2

There's a thing in America whereby people throw 'half Birthday' parties & whilst I don't generally like these made up things I think this year, it could be a good idea for lots of people who've had birthdays they'd normally have a party for.

Try and think about what's fair and reasonable in unprecedented times rather than your absolute rights. Its not their fault any more than its yours. The restaurant business is a tricky one at the best of times - if you know and like the place, help them out a little.4

You probably have a legal right to a refund for breach of contract. It's up to you how hard you push for it.
As others say, if customers insist on deposit refunds, it might make the restaurant go bust.
On the other hand, if you don't insist on a refund, the restaurant might go bust anyway - and you lose your deposit.
Did you pay by card? You might be able to get a chargeback for "Services not provided".1 -
What if you do not want a credit note, as we had booked a special 60th Sunday birthday meal for over 20 people for 2 weeks time, and no longer require a new date. The deposit was £200.00 and they are saying they are not offering a refund at this time, but surely you should be able to get a refund if it is what you require. Just need to know the legal side of this for both the hotel and me. I appreciate it is hard times for us all. We have never been to this hotel before for lunch but it did come recommended, and whilst i would like to help out, I cannot take the financial strain at the moment.0
