Your para re the value of the IIP being counted as part of her death estate for IHT purposes - we are not the Trustees, the Executor is - does this mean that the Trustee could pass on any tax implications to us/the estate? Could you please explain what you mean by “the value of the IIP”?
You should consult the link ( see previous) to Tolley for this.
You mention the solicitors for the Estate and the executor.
You are claiming that the Executor has acted fraudulently? It seems to me very unlikely that the solicitors for the estate (who engaged them?) would collude in fraudulent behaviour.
Or are you claiming that the Executor is showing bias in favour of the beneficiary of the IIP?
You speak of "residue" but is there any residue? You seem to be indicating that the whole value of the estate lies in the property?
If there had been cash in the estate, the Exor could have used this to pay at least part of the IHT due using the Direct Payment Scheme?
