"If your employee is on unpaid leave
You can only claim for employees that started unpaid leave after 28 February 2020."
When did you start unpaid leave?

I am assisting 2 people and wonder if anyone can advise, Thank you
Person 1. Furlough. Will only receive 80% - no top up. Has Lifetime ISA of 10K - for house or pension. 10k saved in savings. Will they be entitled to apply for Universal Credit. They also rent and on the national minimum wage for their age.
Person 2. Furlough on 80%. Only works 20 hours a week. Lives alone in Council flat. Has savings of 6k. Can they apply for Universal Credit and any reduction on Council Tax/rent etc
Thank you for any advice offered

Person 1 not entitled to UC because over savings limit. Similarly CTR.
Person 2 cannot be furloughed if they are still working. Regardless, they can apply for UC and possibly CTR. Whether or not they are entitled to be paid anything will depend on their income.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.1 -
I wondered if Person 1 might be exempt from including the help to buy ISA savings when calculating if they were entitled. Thank you Calcotti for your help0

Unfortunately not. In your opening post you referred to a Lifetime ISA. The value taken into account will be adjusted to reflect the penalties incurred for taking money from it but it will not be ignored.Soogle13 said:I wondered if Person 1 might be exempt from including the help to buy ISA savings when calculating if they were entitled. I am freelance and PAYE. I was working for a film on a dailies (basically zero hour contract) I was on the payroll in January and Feb as a daily, as I was waiting to start properly and to get my contract sent through for a permanent role. I started on 16th March and then three days later the company decided to send us all home until further notice. I am being told I do not qualify for furlough as I wasn't on the payroll on the 28th Feb. Do the guidelines not work in my favour if I was working for them before that date? (I wasn't needed in for work that week) I just don't understand what's so important about that date if I was employed by them before it.
Any help or information would be really appreciated!0 -
I had my contract terminated at 1 yr 350 days on the 20th March. I pointed out they had to inc. the 1 week statutory notice which took me over 2 years, after much stress they have agreed to pay me in lieu of notice so it doesn't go over the 2 yrs but as a gesture of goodwill is going to pay my redundancy.
However, they are refusing to furlough me as they say my new position in the company which I was to start in May has gone due to the Coronavirus and it would be wrong of them to do it only to action the redundancy at the end of Furlough as this would be defrauding the Government!
I have found the Gov info advising they can re-employ me but it does not advise if they can do it if they intent to make me redundant again at then end of this - I thought this was what the scheme was for to help us through this period? Any advise / where I can find the facts would be appreciated. Thanks.0 -
Hi. I was Furloughed on the 1st of April. My business have said they will dock 8 days annual leave from my allowance in the first month and then 2 days for each month thereafter. Not sure this is correct, but can't find anything about this particular subject. Anyone know the rules in this case? Thanks0

Although largely academic, the week's notice (paid in lieu) takes you over the two years so they were legally obliged to pay the redundancy rather than it being a gesture of goodwill! You are also entitled to be paid for any untaken holiday.Rob14 said:I had my contract terminated at 1 yr 350 days on the 20th March. However regarding the furlough, even if they are allowed to do it, they are not obliged to. Given the above, it is probably unlikely they will agree in your case which is their privilege I'm afraid.
