Sports Direct refund postage if item faulty?

So bought 2 pairs of trainers from Sport Direct online (I should have known better)

Opened the first box and one of the trainers has clearly been worn. Its dirty, discoloured, and dirt marks all over the sides and bottom.

So I open the second box and one of the trainers is a different trainer. Similar style but obviously different.

Would these both be classed as faulty? I read on their site that I am responsible for returning goods but nowhere does it state anything about refunding the return postage.

Sending 2 boxes of trainers back in a large package will be expensive. So does anyone know if they refund return postage costs under these circumstances?

Thanks

As the goods do not conform to contract then it is incumbent on the seller to cover the reasonable returns cost. (This is the law - their T&Cs cannot disclaim this liability). How you progress this with a Cashley company is another matter ... his companies' customer services aren't renowned for being consumer-friendly.

    A little update.

Returned items via royal mail 2nd class signed for. Cost £9 99. They received the return. Some joker signed it  COVID.19

They sent an order amendment email confirming they were faulty. They sent refund minus the delivery charge of £4.99.

Now, I've sent 3 emails asking for my postage costs to be refunded. (sent proof of return costs).

All their responses have been generic saying I need to wait for the order amendment email, even though I already have it.

They are being stubborn. My other emails were along the lines of that they are legally obligated to refund costs when items are faulty. Even paypal told me this.

How can I word my next email to get them to budge? They're starting to do my head in

    Thanks

I'm not going to defend Sports Direct, but just want to point out that the signature would have been by a postie and they have pretty much done it correctly.  The policy is that the PDA is not handed to a customer to sign on, instead of that the postie confirms they are accepting the item and then signs on their behalf.  Initially the postie should have put "CV-19" but that has now changed to "XP1", so there is no joker involved.

Our sorting office if we collect a parcel from there is signing on our behalf, covid 19 or similar!
  • If it’s faulty (includes the odd shoe, that’s not as described) you are entitled to return postage back.
