    So after their response from stating the BPA code of practice part b of section 23. I still understand that cases have been thrown out, do I go back with this?

    You are playing a pointless tennis game.  You are right and they know you are, but they hope you will be put off by their smoke & mirrors.
    I agree it is a tennis game but not pointless as it's easy to destroy points such as the CoP that they wrongly think they could rely upon to substantiate their fake £60 claim

    I am currently helping an OP off forum and the replies from BWLegal are frankly so idiotic, it will hang them in court

    BWLegal have a host of fabrications about the fake add-on, none of which are credible.  If they think you don't know about the fabrications, of course they will think they are on winner.

    It might take a few letters but you can destroy their fabrications one by one and as you do, you have letters to show a judge right up to saying their claim is unreliable

    Better than going to court ?

    I agree with Beamer.  I am dismayed that CM and Jonnersh appear to be not taking this seriously, indeed, batting for the other side.  
    You never know how far you can go until you go too far.

    Are you saying that you cannot  complain abiut conduct likely to bring the profession into disrepute? 

    If not, do you nor agree that this is such conduct?.

    Are we really interested in the SRA, they have proved they are just an old boys club.
    They know what's going on, they simply protect, just like the BPA and IPC.

    At the moment we are stuck with proving to a judge that the claim is unworthy and you know, we are getting pretty good at that

    Good Afternoon

     Thank you for your recent email, the contents of which have been noted on file.

     In reference to Claim No. F0DP77KP it is noted that this is a decision made at a Small Claims County Court hearing. This is not binding on our client and our client has complied fully with the BPA code of practice.

     The signage in situ makes provision for our client to recover any additional costs (Contractual Costs) incurred by them in relation to the PCN. The Contractual Costs referred to form part of the terms and conditions (of the parking contract) which were accepted by you in the course of staying at the Car Park. Save for the fact that the sum of [£60.00] attributable towards these costs are entirely reasonable for nature and type of work involved in recovering the parking charge, such costs are recoverable under the relevant parking code of practice.

     Under the BPA Code of Practice, Part B, Section 23 - Recovering unpaid parking charges states, “Where a Parking Charge becomes overdue and before Court Proceedings have commenced, a reasonable sum (which covers the cost of recovering debt) may be added for the debt recovery fees. This sum must not exceed £70 unless prior approval from the BPA has been granted.”.

    You could ask them what LEGAL reason or LAW provides that they can add £60 contractual costs.  By legal or LAW we mean exactly that not terms and conditions (not backed up by statute nor paragraphs in a Code of Practice which is not binding on the motorist (keeper or driver).  They will not be able to answer.  Just check any thread about Abuse of Process by @beamerguy if you fancy a laugh and read about all the times these claims get knocked back in court.
