Minster Baywatch PCN - Can Anything Be Done

We are a small maintenance company that works nationwide, we recently did a job on Heslington Retail Park in York that lasted around 6 hours with one of our companies vehicles on site for the duration, we then received a PCN from the above mentioned company, our admin followed the original appeal process stating that we were on site for urgent maintenance reasons but this was rejected on the grounds that we had not given prior notice, is there anything we can do?

    Was the appeal made as driver or keeper? Hopefully the latter.
    Was a PoPLA code included with the rejection? If so, use it by following the advice in the third post of the NEWBIES.
    Standard appeal points where relevant would include,

    Not the landowner
    No standing (no valid contract) to issue charges in their own name
    Inadequate signage
    Non PoFA compliant NTK
    BPA CoP failures
    Anything else relevant

    What happened when your company complained to the landowner?

    Has a complaint been made to your MP yet pointing out how this unregulated scam is adversely affecting local business?

    Complain to the landowner.  You certainly don't pay this.

    Stage 1 is a landowner cancellation via a complaint

    The best option is always a landowner cancellation , so now you know what to do

    Yes, you can ignore them, if they take you to court sometime next year, (if they have not gone bust),  they would  lily crash and burn .

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully, when life gets back to normal, it will become impossible for those scammers who are left to continue their vile trade, but until this is done you should still complain to your MP, citing the new legislation.

    The appeal was made as the keeper and yes there is a POPLA code. 

    We haven't complained to the landowner at this stage.

    Just to make sure I'm on the right lines is it the Landlord Authority link  need to follow on the sticky?

    The landowner complaint was and still is what should be done , extremely important and unbelievable that it's not already been done

    It was our admin that appealed first time round so were not aware of the landowner complaint, is there a process to doing this?

    Yes, find out who the landowner is a write a stiff but polite letter of complaint finishing with a request for cancellation because .................

    If the landowner hasn't cancelled this by around day 26 then appeal to PoPLA using all the relevant points available to you from the third post of the NEWBIES.

    Post your draft appeal here for checking before it is submitted.

    Don't forget the all important complaint to the Company Director/Owner's MP about this unregulated scam.
