Section 75/chargeback

in Credit cards
Had my car repaired before Christmas because the dpf light came on and car went into limp mode. Was told I needed a new egr valve and filter cleaning, cost around £900. The light keeps coming on every couple of weeks, have took the car back numerous times but it still keeps coming on. I've had the car in for its service and mot at a different garage and mentioned it to them, they've had a look under the car and said in his opinion there's no way they have done the repairs they said. (all nuts bolts etc rusty so they couldn't have been taken out)
Could I claim for this under section 75 or charge back as we paid with a credit card?

You would need to exhaust trying with the garage you bought from 1st. Or CC provider will just ask you to go back. Also would be looking at a 3rd party report backing up your claim that the work was not done.
How long had you had the car before the light issue?

Had it for 18 months before the fault occurred0

No Chargeback then.
I think you would even struggle with S75. Given its a serviceable item.
2nd hand car by any chance?Life in the slow lane0 -

If you can get an independent report that confirms that the work agreed with the repairing garage was never carried out, Section 75 will be the way to go as the supplier (repairing garage) will have breached the contract they had with you to repair the vehicle as arranged.
You don't need to continue any further with the repairing garage, just contact your credit card provider and let them know you want to initiate a section 75 claim due to breach of contract by the repairing garage. They will most likely ask for an independent report to be carried out to verify that the work was never done. Then if the S75 claim is successful, this cost will be reimbursed as a consequential loss.1 -

Yes it's a 2nd hand car but not wanting money back on the whole car, just the work that's been "done".1

If you have proof that the work was not done. Then contact your card provider. Be prepared for a long wait to get through...Life in the slow lane0 -
Yeah, feel bad contacting as it's not an emergency but as far as can tell there's a time limit on claiming?0

We went through the charge back scheme and the money got credited back to us, we had to email our version of events and the garage version theirs, then didn't hear anything for a while so contacted the bank. The person we spoke to didn't really know what was going on. We mentioned the 60 day rule as its been a lot longer than that now but he said it can take longer than that at the minute with the way things are. Does that sound right or now we're past the 60 days can we assume the money is ours? In limbo with it all at the minute0
