section 75 advice needed

hi , 

i need some advice from all u experienced people.
recently i booked flights to india . and i was due to fly on 27 march and returning in april. I paid for the flights using my credit card.

Now due to coronavirus , airline has cancelled the flight. and instead offered us to change the flights dates without any panelty (only fare difference payable) and if we go for the cancellation then the airline will levy the cancellation panelty 

Now i dont want to pay the cancellation fee and its the airline responsibility.  Now airline has cancelled the tickets. But told us if we want to cancel the tickets we will have to do by 24 march in that case a 150 pound cancellation fees will be levied and if we dont cancel by this date whole of the ticket cost will be forfeited. ( we dont want to reschedule)

Now i am not sure should i cancel through airline and claim the cancellation fees through credit card company using section 75 or should i claim the whole amount from the credit card company.

Please advice

    Id give your CC company a call. if the airline has cancelled your tickets why should you be penalised ?
    Avoid India try Cleethorpes Mablethorpe or Skegness instead

    well airline hasn't cancelled the ticket yet. They have asked the customer to call them and have given the customer three choices

    (1) Re-schedule a ticket in which case reissue charges will be waived off . I dont want to reschedule as i dont want to travel on any other date

    (2) Cancel the ticket 72 hours before your original flight date (flight date was 27 march so will have to claim by 24 march) and you will charged a cancellation fee of 150 pounds

    (3) If i dont call  before 24 march  they will forfeit whole of the fees.

    Now the risk for me going with credit card company is we dont know how much time credit card company is going to take to make the decision.
    and if i dont claim  what ever amount airline is refunding and in the future credit card company rejects my claim. I will loose from both ends.. Please advice if i am wrong

    You said that the airline has cancelled the flight.  Ask them for a refund.

    If they haven't cancelled the flight, then you can still travel.

    Yes the airline cancelled the flight. But this stupid airline hasnt cancelled the ticket and it has asked all the affected customers  to call there customer services and presented with the choice i mentioned above

    thanks for your reply..spoke to them three times ...and they are not giving full refunds... they will only refund the remaining amount after deducting the cancellation fees. Thats why i put up this query on this forum on what should i do.

    (1) should i claim the amount after cancellation fees from airline and the cancellation fees from credit card provider 

    (2) or should i claim the whole amount from credit card company which is some risk. As in that case i wont be claiming any amount from airline and dont know how long the credit card company will take to make a decision and if they reject i will loose form both ends

    BTW the airline name is AIR INDIA

    If they cancel the flight you are entitled to a full refund

    make sure it is them that are cancelling the flight

    call them and tell him you want a full refund because the flight is cancelled 

    if they don't do this then you can claim on your credit card

    don't be fobbed off with anything else from the airline

    If they refuse to refund, then you can make a chargeback or section 75 claim from your credit card.  You won't 'loose' from both ends, though it may take a while.

    spoke to them three times...and they are not ready to refund the whole amount. they are claiming its the government which has forced us to stop so its not our mistake..please advice what should i do

    If the flight is cancelled then you are entitled to a full refund from the airline or failing that the the credit card company - both are equally liable

    call your credit card and say you want a section 75 claim because the airline is refusing to refund you

    if the credit card company refuse to do that then put in a formal complaint to the credit card company

    yes it might take some time but these are difficult times at the moment you'll have to be patient

    you will get the refund in the end from the credit card company
