    Thanks Coupon-mad I will do that. I don't actually have an address there yet, will be flat hunting on arrival. I filed 2 DQ's the first before I got the job and the second shortly after, stating a spanish address (our airbnb address for the sake of having something on there!) after following previous advice.

    Hi all,
    I have another urgent update! I received an email from the claimant with their witness statement, but despite giving an address in Spain and requesting everything to be sent via email I never received any updates. I rang the court to check what the situation is and got told the case has been allocated for telephone on 12th October (which will be hard for me to attend). They have said it will be best to contact One Parking Solutions to try and reach an agreement, pay to change the date or find a way to turn up. Do you guys have any advice on this matter? I will have to whip up a witness statement to send to them asap also if I don't agree a solution with OPS if that's the route to go.

    So di you respond to the order? yes or no. Been 6 weeks so I hope so. 
    Did you check junk mail every day? Did you get any physical mail?
    Your DQ will have said dates youc ant attend, so if you didnt put 12th down as a date you cant attend, tough. Thats your job to organise. 

    Clearly you should have already sent a WS and evidence to them and the court...i presume you asked what the deadline for that was? Have you INSTRUCTED OPS on your new address? Simple yes or no.

    Yes order was sent ages ago in plenty of time.
    Physical mail was apparently sent to old address in UK despite me instructing otherwise.
    I informed them of move to Spain but could not simply rule out every date in the future! Sure I can find a way to be on the phone if necessary.
    They have basically said ASAP for WS but as long as it is on the judge´s desk on the day that is fine.
    Yes they know my new address.

    Who did you instruct? The court AND the claimant? Did you get confirmation from either? etc. 
    Yep, so you will need to find a way to attend. 
    If youre staying overseas permanently, they cant actually do anything to you/ The judgement has no validity outside of E&W
  • Yes I sent the N159 to both and received an N159 from the claimant too saying they wanted on purely on the papers. All confirmation seems to have been sent to my old address so I never received anything hard copy. 
    If a judge passes a CCJ to me though, does that not still affect credit rating etc in the UK? I plan to be abroad long term so am a little unsure how this can affect me. I understand a CCJ stands for 6 years which I'd rather avoid either way!

    Your understanding is correct.

    If 'long term' means over six years, it won't affect you.

    So basically if I get a CCJ but don't pay it, it will vanish after 6 years regardless?
