County Court Claim Form HELP PLEASE!

Hi there,
I received a parking fine in October 2018 and followed varying advice on threads on here but it hasn't gone away sadly. I received a County Court Claim Form today and want to know what to do next. It is from One Parking Solutions with DCB Legal LTD acting as their defence. It was a £60 fine originally and they are now claiming £231.03 (£156.03 claim, £25 court fee, £50 legal costs). What are the essential steps I have to take at this point and can I get it reduced by admitting part of it?

    No , fight it all the way

    Post the issue date from the claim form below

    Email a SAR to the DPO at OPS to obtain all your data , attaching a copy of the claim form as proof of I D under the GDPR law

    It's your defence , not dcbl , dcbl are acting in a legal capacity for their client.  The claimant

    Dcbl are definitely not acting as defence

    What should I include in the SAR??

    With a Claim Issue Date of 17th March, you have until Monday 6th April to file an Acknowledgment of Service. If possible, do not file an AoS before 21st March, but otherwise there is nothing to be gained by delaying it. 

    Having filed an AoS, you have until 4pm on Monday 20th April 2020 to file your Defence.
    That's over a month away. Plenty of time to produce a Defence, but please don't leave it to the last minute.

    Guidance on creating a Defence is also in that thread - in the first post on that thread.

    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    include a copy of the claim form like you were told earlier, plus read the newbies sticky thread , second post regarding court advice and SAR advice etc, plus the link in the last reply too

    common acronyms are in the fifth post in that newbies thread

    Hi,

    I'm drawing up my defence and amending the template form. I'm a little confused what to put and how to present info in point 16 where I add case specific info. The only piece of info I definitely need to include is the fact that I was displaying a valid permit and ticket at the time.

    Well only you know the circumstances , so write your best efforts for 16 and 17 and post them below , nobody here will write them for you and over 90% of the defence has been done for you , so put some effort in on those two paragraphs

    Read other recent submissions on here for the same two paragraphs and see if any suit your case, you only have to read anything posted since Feb 2020 !!

    I deleted point 16 as I was the driver...was this correct?

    Use the forum search facility - Advance search and put New Template Defence in the "search forum" box.  See how many people have been advised to search for it and then follow their names.

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    Would this serve as a suitable defence for point 16? Thanks in advance for all your help.


    The alleged offence occurred at the University of Chichester Bognor Regis Campus where I was a student at the time. There was a valid parking permit and ticket displayed in the car at the time the PCN was issued. The alleged offence was for parking outside of a marked bay, although the car was parked on tarmac between 2 other cars, not blocking any entrances or exits or restricting the movement of other vehicles in the carpark. On that day, the University was holding multiple events and therefore the carpark was far busier than usual, something that the University apologised for not warning their regular visitors about. Since the issuing of the PCN, I received vast quantities of letters and phone calls from various companies demanding payment of the PCN along with over-inflated extra charges. These included a claim from ZZPS Limited for £150, QDR Solicitors Limited for £162.50, Direct Collections Bailiffs Limited for £140 eventually rising to the current sum of £156.03. Seeing as I never entered into a contract with any of these companies and their fees are clearly arbitrary and exaggerated, it would be fair to say that their method of operation is aggressive and has caused significant stress.
