What can I do to get my N95 fixed?

On my brothers N95 the volume up/down key on the side of the phone has broken. He's had the phone for 1 month and it is with Vodafone (on my account) and was bought direct from them.
Rang up yesterday about getting it fixed and was told that with it not being in its 14 days cooling off period the only option was the manufacturers warranty which could take up to 35 days. Is that right or could I use the Sale of Goods Act to get them to send out a new one and send them back the old one, basically not have to go through Nokia and the associated time frame?

fonefix in york have a very quick turnover, usually 3 working days, inside of 28 days they should exchange, after that it's a warrenty repair.It is better to be thought of as an idiot than to open your mouth and remove all doubt0

Im on my 5th N95 since June as an upgrade...
02 sent me new phone everytime I complained. Then on the 3rd handset, they send out a recon one. Which I saw my !!!! about!
Anyway, yesterday they sent me out a brand new SE K850i and I get a tenner off my line rental for a few months.
Love the n95, but terribly built...!0 -

Would I be able to use the SoGA to get them to send me (my brother) out a new N95 (to swap for the old one) so that he has no time with his handset or would the SoGA just mean they have to repair it (which they have offered to do)?0 -

Hi,
It seems like you may have been given some duff information and I can explain the correct details for you with working for Vodafone myself.
After the 14 day cooling off period of your contract, your warranty cover kicks in and a new replacement can not be sent. With our warrantly procedure your phone can be sent off for repair which normally takes around 5 days, not 35 as mentioned earlier in the thread. I apologies to anyone who was advised incorrectly about this.
You can either visit your nearest Vodafone store and have your phone sent off for repair or you can e-mail or call us and request a repair pack which we'd send to your address for you to return the phone back to us via Royal Mail. Normally you'd have your phone back and repaired within 3 working days.
