Those dates you have supplied are confusing me.
Can you possibly copy and paste an extract from your MCOL Claim History?

haha sorry 28/02/2020Umkomaas said:
Not possible. It's only 16/03/2020 today. Are you a Time Lord?cheirourgen said:Sorry AOS was submitted 28/03/2020 - received on 02/03/20200 -
From your last few posts I have gleaned:1) You have a Claim Form with an Issue Date of 28th January 2020.2) An AoS was submitted on 28th February.3) The AoS was received on 2nd March.
If that's so, then you have been incredibly lucky not to have received a Judgment against you.
From 17th February until you filed an AoS, around two weeks, the Claimant was free to seek that Default Judgment.
Anyway, we are over that hiccup. On to the next one. With a Claim Issue Date of 28th January, and having filed an Acknowledgment of Service before the Claimant woke up, you had until 4pm on Monday 2nd March 2020 to file your Defence.
Sadly, you have missed that date too.
The Claimant is again free to seek a Default Judgment against you.
You are now in a race. If you file a Defence before the Claimant seeks that Judgment, you go through to the next round. If the Claimant gets that Default Judgment before you file a Defence, then it's game over. You lose.To file a Defence, follow the guidance in this post:Guidance on creating a Defence is also in that thread - in the first post on that thread.3 -
Ok I'll get writing now! Thanks for this....
Also regarding my earlier question about the parking lot no longer being under the management of 'vehicle control service' - can they still claim? and how can I prove the signage wasn't clear if it's all changed since then?0 -
Yes they can as they did so at the time
Email a SAR to the DPO at VCS to obtain all your data attaching a copy of the claim form as proof of I D under the GDPR law
The exhibits exchange will come near the court hearing date
Try Google Street view for signage at the time0 -
Yes, if everything else is valid then if VCS were 'in control' on the date of the parking incident, then they can legitimately continue with the claim.cheirourgen said:Also regarding my earlier question about the parking lot no longer being under the management of 'vehicle control service' - can they still claim?
By looking for earlier photos - Google Images, or Google Street View.cheirourgen said:...and how can I prove the signage wasn't clear if it's all changed since then?
Maybe by searching this forum. Has the car park been mentioned before? Do other victims have pictures?1 -
As above
BUt get yoru defence in today
You have managed to totally miss the VERY clear deadlines printed on the claim form, and you are risking a default
If you get a default, you wil lnot be able to get a set aside. So, file before 4pm TODAY. You are out of time to ask questions. Get it filed. NO EXCUSES - no delays - nothing.1 -

Have they complied?Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
You never know how far you can go until you go too far.0
