ok so im past the 12 working days now
Im happy..But do i need to do anything? do i need to point out that they have gone past the 12 working days or do i just sit back and see if anything else turns up?
If they do send me the info i have requested, but its outside of the 12 working days, then what?
Also on a side note..it might be worth everyone starting there own threads rather than taking over this one..It would be much easier for people to offer advice then..rather than them all getting mixed up:beer:

I would be inclined to let them stew for the next 30 days. After that, you need to send the them the bogoff letter and report them as weller suggests, otherwise, they will just sell the debt to some other DCA.If you've have not made a mistake, you've made nothing0 -

Also request a statement of account, and deed of assignment.
They are trying to bully you, don't fall for it, and be robust, once they fail to come up with the agreement, go for them and demand compensation for the trauma they have caused[strike]Debt @ LBM 04/07 £14,804[/strike]01/08 [strike]£10,472[/strike]now debt free:j

Dear Sirs
I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.
1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx.
2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.
3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not.
Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.
As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.

Have also received letter from this company which was addressed to my son (didn't realise till I opened it.......as he hasn't lived here for 10 years!)demanding £954.59 for monies owing to Barclaycard.I phoned them and told them that and also that he had emigrated to Australia two years ago and good luck if they wished to pursue a debt which did not exist. Will update if I hear anything back ........but was wondering if this would affect my credit score.......do I need to get my details from Experian to check?0

I also received a few demand letters from these people (Red Debt collection/Lowells).
The letter was sent to my mum's address.........i haven't lived there for almost 8 years!
They're claiming i owe almost £1,500 to Barclaycard, which i'm sure i do not owe. Although admittedly, i cannot say 100% - as i did owe money to a few companies years ago........i'm talking 15 years+!
But to be honest, i don't remember having a Barclaycard back then and i have had a Barclaycard recently (2 years ago) which i paid off totally & have a good record with - a recent Experian credit check verifies this.
I've heard this company 'buys' old debts or even sometimes 'fabricates' these so called debts, which is probably the case here.
My main concern is for my Mum, as the letters are going to her address. Will her address be affected? i.e concerning credit scoring etc.
Also, i don't want to alert these people to the fact i am at a new address, by contacting them myself - but i also don't want my Mum to keep receiving these annoying letters.
Any advice on what i should do?
Thanks for any replies.0 -
Hi
This is almost certainly statute barred, so you do not need the CCA letter. Will find and post it up. Does it show up on your credit check? If you've have not made a mistake, you've made nothing0 -
Almost certainly statute barred then, unless they got a CCJ against you.
Must get something to eat but will be back.If you've have not made a mistake, you've made nothing0
