complain to the SRA about Gladstones, they are fully aware that their claim contains an unlawful amount.
https://forums.moneysavingexpert.com/discussion/6014081/abuse-of-process-district-judge-tells-bwlegalNine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

GLADSTONES SPANKED AGAIN, THIS TIME BY THE WORTHING COURT ?
Claim number F0GF1K4A and we think it was D.J.Harvey
Gladstones did not bother to turn up again (such a rude bad habit).
proudsonofduck was awarded £293.02 with the judge quoting Judge Grand's reasons being ABUSE OF PROCESS and adding ....
"Deliberate attempt to mislead the court"
"In contempt of court"
"Cut and paste witness statement with no attempt to address the defence"

The judge said the £60 in not lawful and claimant rep said they no longer are seeking it (so only the £100). ???
GLADSTONES CAUGHT OUT IN COURT AGAIN
THIS IS THE DEMISE OF A VERY DODGY LEGAL WHO DOES NOT UNDERSTAND THAT "TIME IS UP"1 -

There is no template needed for emailing one line where I gave you both phrases! Obviously use formal salutations (the rather sexist 'Dear Sirs' is the normal one when addressing a solicitor).
No starting ''Hi'' in the email, like some posters unbelievably keep doing. My lovely and intelligent University student kids don't know how to write formal emails either, they always ask me. People aren't taught formal salutations & 'letter sign offs' these days.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all, hope everyone is okay in this crisis!
Received my SAR back. I have a couple of questions. It looks like they have relied on POFA in the notice to keeper. It was received over 28 days after the windscreen ticket. It attached a copy of the photos of the car (no signage in these) and one of the payment machine. Am I banged to rights here? I never appealed initially due to a bereavement at the time...
Besides abuse of process and possible lack of signage is there anything I can add to a defence to make it a strong case?
Kind regards

Which parking company? LPS could be one of three:
Local Parking Security
London Parking Solutions
Llanwnroc Parking ServicesIt looks like they have relied on POFA in the notice to keeperThey might be attempting to rely on PoFA, but unless they meet all of the Act's requirements, they cannot transfer liability to the keeper. Meeting the timing schedule is just one requirement. Are you telling us you've checked the NtK against every PoFA requirement and it meets each of them? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
