Bought tv online and need to return it

Hi I'm looking for advice on a TV I bought online from AO 10 days ago. 
It's a toshiba 58inch 4k tv. It was to replace a 10year old hd lg tv. I'm off work on the sick after an operation so tv is all I have lol. 
So thought to upgrade my existing TV. Thinking a 10 year younger 4k tv had to be better, saw a toshiba on AO and bought it through their buy now pay 6montgs later. I got the TV on the 2nd of March and my son kindly set it up. I've spent the last 10 days trying to retune all the features to try and get a better quality image as it's quite frankly not as clear and sharp as my old hd tv. Had problems with the on board apps and the remote. Finally rang Toshiba and the engineer said that sadly the 10year old LG is a better TV..... And after restarting the TV for the 5th time in 10 day got the e apps working again for the 5th time. 
Thought I'm not going through this again and again so called AO to explain to them. 
They said I can return the TV but because its open they would have to apply a 10% retention (better than the 45% they first said!) I said I thought as I'd bought it blind from the net and had informed them within 14 days that I would be entitled to a full refund but they said no. Just because it doesn't have as good a picture as I was expecting then they can still apply the retention policy. 
I was wondering. Is this the case? 
Could you please let me know ASAP as I think I now only have 14 days in which to return the TV.

    They are entitled to make a deduction in line with any usage the TV has had over any handling that would have taken place should you purchase it from a shop.

    If you are saying it is faulty, then they need to refund.

    But I think you are saying that you didn’t do your homework well enough, and the spec is actually not as good as your older tv? In which case, given you have spent 10 days using it, setting it up etc... then they will be able to deduct a small amount for having to reset it. You do still have the box and packaging?

    Provided that if asked to do so, the OP is able to prove that the set is faulty.

    Hi thanks for your reply. Yes I have all the packaging. Checked out as many reviews as possible that should have meant the 4k was better than the old LG. As its 10 year old I couldn't get the exact specs for both. So had to rely on the reviews. Which still are not as good as seeing it in the flesh before hand.... But that's my mistake. 
    Just asking for advice as someone else has said that it might not apply.

    You might also face issues actually finding a way of getting this back to them, TVs are a notorious for being excluded from cover by many couriers, and if you find one that will take the parcel it is likely to cost you a great deal of money.

    Using the TV for 10 days goes beyond what is reasonable to determine the nature and functioning of the goods and therefore they are fully entitled to apply a deduction as the value of the goods has diminished due to you handling the goods more than what was necessary.  All covered by the Consumer Contract Regulations 2013, and be aware that you have 14 days to cancel so you better get a move on.

    You do realise that 4K is only "better" if you are also subscribing to 4K material, of which there is a dearth at the moment even if you are prepared to pay for it? 
     In future, I suggest you only buy a TV set after seeing it in use in a showroom.

    is the only Toshiba 58" 4K television sold on AO.Com, you are correct.
    Less than £350 for a 58" 4K set is extremely cheap.

    Yep was budget. All I could afford unfortunately. I'm not a technophile (?) but thought from on line reviews that it sounded a good option. As per previous comment above, I know that unless I'm watching a 4k (ish) programme such as on netflix or prime the majority of stations I wTch on sky are in HD. But even these were in poor quality. Sad to say I wrongly thought that after 10 years and prices coming down on components etc that the TV would still be better than my old one. Anyway, thanks yo all who've commented. Tv is going back on Saturday with a full refund now rather than the 10% retention that I was happy to pay. AO are a good bunch.
