Standard operating procedure. Seems they usually follow the same pattern. 1) Standard meaningless defence to gain maximum 28 days to respond properly. 2) Check they haven't a leg (or brain cell) to stand on and so then make a full offer at the last breath before you ask for judgement. Provided they're legless as well as brainless you should have no problem.0

Update.....and result:T:T:T:T
In today's post I received 2 letters;-- Via SD from CPW (obviously dated yesterday). Letter offering full amount claimed plus interest to date in full and final settlement, on a without prejudice basis, without admitting liability. Enclosed was a cheque for the full amount due plus a letter for signature and return to CPW by me, addressed to the Court Manager, confirming the claim has been settled directly with the defendant. Cheekily this letter is dated today.
- A letter dated 1/4/08 from the Court, enclosing a copy of a fax dated 28 March (the date CPW had to submit a proper defence) from CPW's solicitors saying that they understood that the defendant had settled with the claimant (cheeky, in view of date of letter above). The Court enquired whether matter is settled or not and enclosed form N225 for completion.
A very satisfying outcome indeed:D A big thank you to mj:T To Quentin......without your advice and encouragement I may well have given in before now....so a massive vote of thanks from me:beer::beer: Hopefully this outcome will encourage others to take the bampots on and see their claims through to the bitter end:D

They didn't pay out on one of my claims (fourth of four) - said it hadn't arrived (was sent SD and have written confirmation from Royal Mail that it DID arrive).. Sent LBA giving them ten working days to pay it. No response. MCOL filed today. What a bunch of idiots.
I must say that these cashbacks are just a waste of time. I've had a few and always got my money, but unless you are some kind of fanatic or are desperate for a hobby there are better things to do in life than chase E2S.
I now have a couple of £10/month 300/300 contracts with Virgin and looking forward to using my time more enjoyably.0 -

I've just phoned e2save on their 0800 sales no. and eventually spoke to Gavin (supervisor?). He reckons that the number of people having probs are a very small % of their customers. I've tried and tried to get through on the 0871 5223400 no. but no joy. I sent an email and had a call back from 02082 961473 (CPW) but they hang up as soon as I answered and when I rang back I had recorded message "we rang you but dont worry, not important we weil ring you back".
I am pulling whats left of my hair out. I spoke to OSPS customer services months ago and the guy was really helpfull and told me the dates to send off etc. but last month they sent me 2 "late" letters.
I am tempted to just keep ringing the 0800 no. just to feel I,m fighting back but that might be seen as harrassment.
I'm sorry to whinge but all this stress is compounding on existing stress of approaching redundancy and my head is not in a very good place (if you know what I mean)

You don't actually say what you are calling them about, so it's a bit difficult to advise. If it's about a refusal to pay cashback then I would advise, if you have complied with the T & Cs go down the LBA---->MCOL route. There really is no point in ringing them - you are actually paying them more dosh on an 0871 number, when you really want them to give you dosh!
If you can fill in some more detail I'm sure all would be willing to advise. With the stress of impending redundancy I'm sure this is one problem you do not need. Good luck:)0 -

Just a quick thought, should I still be sending in my cashback claims as usual ? (i have been to date to be on the safe side, even though they just reply with the standard missed claim window letter)0 -

thanks for posting the update and letting us know how you got on in your battle! i hope it goes the same way for me, im 100% certain i am in the right but it does take up some of your time and energy. however i cant stand by and see injustice, especially when its someone trying to rob me in daylight.

i havnt been sending in my cashback claims as usual since i made my mcol for the full remaining amount, and wont be settling for any less than that. im not sure if thats the right way to do it though..

You should continue to make claims until your case is settled and you have been paid (a defendant can appeal the court's decision).0
