unresponsive dealer - car missing advertised options
Options
Hi all,
Bought a 67 plate car, wasn't cheap at 18,000 from a main dealer. Typically, they were really helpful up until they got my money. At which point, I've now got radio silence. I have been emailing them but wanted to confirm options before I call.
There are 3 issues with the car:
1. The wipers do not clear rain effectively, quite dangerous and for manufacturer approved I would expect this to have been replaced prior to approval. I did test them with the washer jets and they were alright, not brilliant. But it was a sunny day when I bought so thats all I could do. With rain, they are ineffective, leaving smears. Surely I'm entitled for these to be replaced on grounds of safety?
2. The advert listed the car as coming with Apple car play, I didn't have a cable to test this at the time. However, when I got back, although it has the software its saying I need a code to activate it which is going to cost between £150-200. I've got a copy of the advert and its one of the headline items.
3. There is a clip missing from inside the car, more of a minor point but didn't spot it on the test drive. I'd want this to be rectified too.
So what are my options? I only purchased it 9 days ago. I've got a copy of the advert so plenty of evidence to prove my case. I imagine they'll try and wriggle out of it, so how do I stop them?

If you aren't getting response by phone go in to the dealership. The sales guy can't ignore you then. Strictly wipers are a consumable, but they will no doubt change them. Though them being worn is only one symptom of streaking.1

1. So you're hassling about a new set of wiper blades...? A few quid's worth of routine consumable.
2. It has the Apple CarPlay software installed. You just need a licence code to use it. If it didn't have it, the code would be useless.
3. What "clip" are we talking about?
These are no way substantive enough points for a CRA rejection - but if it was a manufacturer approved-used, then you will probably have a blanket 30-day, 1.000 mile exchange available.0 -
I am in a similar situation as your after buying a used car from a main dealer. See my other posts.
Your first call must be in writing (email) and a phone call to the make a complaint giving them an opportunity to rectify the issues.
After giving them some time to respond.
Use resolver (free complaints tools on MSE) to exercise your consumer rights and just ask them to repair / replace or refund.
Hope this helps.1 -
you really don't need to go nuclear straight away.0

2. Not sure the point you're making on this one. It says it comes fully equipped with the software, yet I can't use it unless I get it activated with the code. That is misselling in my view. At no point was it mentioned when I asked about it that I'd need a code to use it which would cost £150-200...
3. Its a part missing that covers up some screws. Its on the other side of the car but not this one.
I'm not looking for a CRA and yes I do think I have that option on the 30 day exchange. However, I'm more looking to give them a kick up the back side and get them to sort issues that should've been sorted with the numerous checks they do on the car, as well as give me what was advertised.2 -
Go to the dealers with the car, explain the issues any decent dealer should rectify all 3 of your issues and as yet you dont know that they wont, please come back and tell us what they say though1

The question we can answer is surely more what your position is if they refuse...
As far as CarPlay goes, there's two elements to it. You buy a new car that's got the software installed, and you need to buy the licence code to activate it. That activation then applies to the VIN of the car through its life (or until Apple decide to withdraw or change the service - and they will certainly have retained that right!). So you are in the same position as if you'd bought this car new. CarPlay is installed. If you wish to use it, you need to pay Apple's fee to do so. The person who had your car before you didn't - that doesn't mean it isn't installed.0 -
What make of car?
Apple car play does not require any activation code. And is a free to use, unless car manufacture charges you.
BMW used to charge after 1st year, but this was due to the way it was integrated into their software. Dropped last year.Life in the slow lane0 -
