New car issues

Hi I am new to the forum and hope someone out there will be able to help.
My daughter in law purchased a new vehicle on 1st March with a new registration mark 2020.  The purchase is under a pcp agreement. Once she got the vehicle home and started to try out some of the features the vehicle had. She began to realise that not everything that was in the specification was there. She has contacted the dealership and their initial response was negative.  After some persistence from her the dealer has said that they will see if they can tweak some if the features but not all. She is not happy with this and basically wants what she believes she is paying for.  She part exchanged her old car for this new one.  As the vehicle is under a pcp can she insist on returning it to the dealership without any penalties under the 14 day cooling off period?  Thank you in advance

    The 14 day cooling off period is for the finance product, NOT for the vehicle.  
    There are protections for actual faults, but contractual issues like what is included compared to what is shown as ordered should be sorted out before taking delivery.  What is shown on the order form that is missing from the car that has been delivered?

    The Consumer Rights Act 2015 makes it the finance company’s responsibility to supply what the customer ordered, and the customer can reject it within 30 days if it is not what they ordered. It would be reasonable not to accept the car at the dealer if it is the wrong colour, but  omitted equipment might not become apparent for days. 


    The contract might give the finance company some rights in the event of insignificant differences (e.g. substitutions of equal value) but omissions would justify rejection.


    You might agree to reduced monthly repayments if the omissions were not fundamental to her enjoyment of the car. 


    Note that the consumer rights act applies to the contract between the finance company and the consumer. The finance company bought the car from the dealer to supply to the finance company’s customer.  This was a business transaction and is not covered by the Consumer Right Act 2015. 

    She should reject the car with the finance company within 30 days if the omissions are going to affect her enjoyment of the car. If she has home insurance, she should check to see if she has legal cover so she can get a solicitor on the case, and speak to them before rejecting the car. 

    The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.
  • It is a Fiesta ST. The dealership showed her a spec of what she would be getting in the 2020 model. She got a Fiesta ST but it transpires it is a 2019 model. I don't know the full list of missing features. I know that privacy glass was one thing and there was no sat nav. They are going to sort the sat nav issue I believe.

    I really wouldn't take a motor manufacturers sat nav, keeping them updated can become expensive.  Google maps for me.

    Was the car supplied from stock, rather than being a factory order?

    When did she order it?

    I thought all STs came with gangsta windows and integrated SATNAV :o

    What exact model is it? and what did the order form say the model was?
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))

    I don't mean to insult her intelligence but is she sure the car doesn't have these features? 
    Privacy glass and SatNav are standard features on all Fiesta ST models since 2018.
