Amazon claim I sent back different item in box.

    For a third time, I'll ask the OP to reveal whether he has previously returned items in this manner because he was apparently sent the wrong item? If this is not the case it is exceedingly unusual for Amazon not to simply accept the customer's word and refund or exchange without any question. 

    I'd also like to know (truthfully) on what basis Amazon  have refused to return the "wrong" item. Have they said they cannot return it at all or only when a full investigation has been carried out? 

    Accusing Amazon of "theft" is likely premature and/or unwise  given we have only one side of the story...

    Sorry, my fault I assumed it would be assumed by me still be able to order I haven't got a history.
    I have returned a few items in past yes, so you could say I do have a history in one way but it was more things like one time I ordered wrong fan for a raspberry pi, one time I ordered a raspberry pi with already soldered headers and wanted headerless and once for something I got cheaper elsewhere (and cancelled before it was sent)

    A likely scenario is that somehow a 1080 card got into a 2080 box prior to it being dispatched to you and you assumed the product was what you expected and what the box said it was.
    The OP mentioned earlier in the thread that they apparently photographed a 2080 card prior to despatching it back to Amazon. 
    True, but the OP only a says they photographed the card they were sent - I couldn’t see anywhere that actually says this was a 2080 just that they sent back the one that was sent and some info about the different serial numbers.
    Nowhere does the OP categorically state that the card card they received was a 2080 - it reads that this was assumed
    OP - do the photos clearly show the serial number and how does this compare to the card that Amazon claim to have received ?
    What is the price difference between the1080 and 2080 ?
    Either way - they cannot keep the card and the money

    A small update, Amazon are saying they don't have to send back and have destroyed the item when I asked for serial numbers!

    Then they have to refund you - send them a LBA informing them that they must either return the item to you (not now possible) or refund you and be prepared to take it to small claims

    Agreed. But also be prepared to lose your Amazon account ... i.e. that they'll choose to no longer do business with you.
