15 month old iPhone from Carphone Warehouse - how do I fight my case?
Hi,
I got an iPhone XR on a 24 month contract from CPW. It had a fault with the audio which was fixed around August when it was 8 months old in the Apple store as they do when your phone is less than 12 months old.
Now it's 15 months old and the same fault has returned. Apple won't repair as it's out of warranty, Vodafone won't repair as it wasn't directly from them but they would have done otherwise according to their policy.
Carphone Warehouse took the phone to repair but are now refusing to do anything without me paying for it. I know consumer rights can be a bit murky and hard to argue with retailers but I would expect that if you sell a phone on a 24 month contract it should at least last the length of said contract... or am I being unreasonable? Not sure what I can do and we really need the phone back!

Sadly, I don't think the contract length is related to the phone longevity - they're separate things. Virgin offer 36 month contracts - where would it end? I believe at this point, it's now up to you to prove an inherent fault by way of a report, but whether this is worth the effort compared to the repair cost is for you to judge1

Definitely go down the consumer law route. Reasonable life span for a smart phone is at least 2 years. Get an independent to do a report and present that to CPW. If that fails then small claims court. CPW are part of Currys pc world who are notoriously bad at customer service. In future if you can, buy from JL who offer 2 year warranty which I know from personal experience is very good. And then get a sim only deal from a carrier not a third party which CPW are.1

Ironically, if you were abroad in the EU, the Apple warranty is 2 years, even for one bought in the UK and taken abroad... A friend had a UK purchased iPad that was around 18 months old, it was repaired by replacement in an Apple Store in Spain. Rip off Britain!
