    Thank you for that think will just give the 2k back to or ASAP and you don't think he will that bothered that I spent the other 2k on bankruptcy  fees and getting clothes and stuff for my kids (sorry for all the questions )it was all essential stuff for the kids no treats

    If you’ve not been asked to explain it I’d say the OR isn’t bothered. It’s not like you spent £2k on a holiday in the sun. I’d not worry about it

    Agreed with pretty much everything on here.
    If your only income is from benefits, then there will be no IPA.
    Money in your wifes account is nothing to do with your bankruptcy (as long as it's not a joint account).
    It sounds like the OR thinks your case is simpe so doesn't need more information.
    If they are only asking for the 2k back, then they probably aren't interested in the other 2k, nearly £700 of that would have been fees, so it's only £1,300 anyway.

    Send the 2k off that the OR requested, relax and wait the year out, enjoy your holiday with the family. Although BPD makes it easy to get in debt, it's also easier managed without the stress of debt over you.

    Worse case imho they could give you a BRU (saying you need to tell creditors about bankruptcy for longer, and restricting the amount of credit you can get) for a couple of years 

    There’s no sensible way the OR can recover the money as you don’t have it, you can’t afford it and neither do you have assets(ie it’s not like you purchased a Porsche which is on drive, which they could recover the money from)

    the chances of anything happening as a result of spending 1300 on clothing and stuff for kids is very very slim (about as much chance of winning a decent prize on lottery).

    As said, they can't recover it. The OR will most likely understand that you've been living without money for some time and that there is a list of essentials that needed replacing. Kids need a complete new wardrobe every year or so depdinding on their age, doing this can rack up quite quickly. They'd have no interest in recovering clothes as they would barely get anything back for them and put your kids in a place where they don't have what they need.

    Thank you everyone for all you're replys sending letter to or today will explain that I didn't know I couldn't spend money but was on the kids and the other 2 grand I can get back and will send it to or when he asks for it thank you all again  you have put my mind at ease

    If the OR hasn't mentioned the missing £2k, it would probably be best to not bring it up (as long as they already know about it) and only mention the £2k you can get back. Enjoy the start of a new life :D

    One final point I forgot to say when I got the refund i moved it all to my wife's account  as she deals with all the finance after I had a nervous breakdown  in 2015  will the or get funny about this and does it mean he can now search her bank account even though it's just her name on the account  sorry keep asking questions

    I can realte to that, night time is when everything goes quiet enough for thoughts to run wild.
    I'm not 100% sure on how that will effect it. Before I went bankrupt I cleared any cash out of bank accounts so they were empty. Althought it's a different situation it was never questioned. I would hazard a guess as it's only £1,300 unaccounted for that the OR will likely see it as a reasonable amount to live on for the month while everything gets sorted out so probably won't mention it. If they haven't mentioned it yet then chances are that they aren't interested in it.
