Warranty: Replacement only; refund denied.



I purchased a battery just over a year ago from Tayna batteries. The battery is now faulty and I opened a warranty claim. All is well so far and the claim has been accepted subject to their inspection upon return. Great. My only issue is, they have refused a refund on the item and offered only a replacement. I am genuinely not happy with the overall quality of the battery. It wasnt that great to start with and although researched initially, i am now finding bad reviews. I want to refund and I'm ready to hit buy on a different battery at the same price with the same company.
Where do I stand? Are they within their rights to offer replacement only?

A warranty is something that a company is not legally required to offer so they are entitled to state whatever T&C's they wish (provided there isn't something that is illegal).
Even if you were claiming under your statutory rights, if the Consumer rights act applied, the ultimate choice of a replacement or refund rests with the seller and even if they refunded, they wouldn't have to give a full refund as they can make a deduction to cover the years use you have had from the battery.
From their website:Faulty Items
Although faults with batteries are very rare, we do occasionally get items that are faulty after purchase. We aim to handle all faulty items returned to us as quickly as possible to avoid inconvenience to you. We strongly suggest checking that your battery is where the fault lies as in many cases it could be a faulty alternator or boot/glovebox light sticking on that is causing the indicated problems with the battery. As many as 50% of batteries returned to us for test are simply flat and need recharging!
After a faulty battery is confirmed we will pay to ship a replacement back to to you, but where no fault is found, unlike some companies we don't charge a test fee but we do have to charge carriage back to you at cost. Any non-faulty items not collected within 3 months will be diposed of.

Just in case anyone else reads this, Tayna are a great company. Ive been using them for years, replied to warranty query within 10 mins.. on a Saturday! and offered me discounted shipping on the returns.0 -
